Mr. Smith stated the street is urban section,not curb and gutter. He will place a berm to <br /> the north, next to the Forsberg property,to hold the water in the open space. He will also <br /> place a berm with trees along the Manufactured Home Park. <br /> Covenants were discussed. If the City is included as a part of the covenants,the City can <br /> enforce them. The City can choose to be involved or not. The Planning Commission <br /> needs to review them during the platting process. <br /> The City Engineer will need to comment on the Preliminary Plat. There is no problem <br /> extending water to this development and there is capacity for wastewater. <br /> Mr. Smith stated the 40' X 64' building sites will allow for different designs. The entire <br /> building site will not be filled. <br /> Suggestions for Mr. Smith: <br /> 1. More space between dwelling and street. <br /> 2. Road connection to the north. <br /> 3. Open space should be connected(future developments). <br /> 4. Utilities will be tight in ROW(XCeI,power,etc.) <br /> The Planning Commission stated this is a much improves design. No zoning change is <br /> required to proceed with this plan. <br /> APPLICANT: Wilderness Point Villas, LLC <br /> Applicant requests Final Plat of Wilderness Point. <br /> Mr. Marohn stated that City Attorney Sandelin hand delivered the Developers agreement <br /> after 4:00 p.m. today and he recommends approval. Jeff Miller, WSN,was present <br /> representing the applicant. <br /> Mr. Williams stated that 3. d.of the list of conditions for Preliminary Plat,the rental <br /> contract and association documents need to be approved prior to Final Plat approval. The <br /> rezone of the open space could be added as a condition of Final Plat. Mr. Marohn stated <br /> that the applicant agrees to rezone the open space to Open Space. <br /> A motion was made by Dean Williams, seconded by Mark Hallan,to approve the rental <br /> contract and association contracts. All members voted"aye". Motion carried. <br /> Mr. Miller stated that he had a completion dated included in the Developers Agreement <br /> of 2010. They had been unaware of the Park Dedication Fee until recently. There are <br /> park facilities included in the development.
