COMMUNITY GROWTH <br /> September 26,2007 ri 1 N S T 1 T U T E <br /> Mayor and City Council <br /> City of Pequot Lakes <br /> 4638 County Road ii <br /> Pequot Lakes,MN 56472 <br /> Re: Planning Commission Report <br /> Dear Mayor and City Council, <br /> The Planning Commission met for their regularly scheduled September meeting at which they <br /> held three public hearings. The Planning Commission approved a conditional use permit for a <br /> Curves Fitness Center, reviewed and tabled a variance request, and reviewed an ordinance <br /> amendment regarding the establishment of new criteria for park dedication. <br /> The Planning Commission is forwarding the following recommendationS for your consideration: <br /> HEARING: Ordinance Amendment Regarding the Establishment of New Criteria <br /> for Park Dedication,City of Pequot Ickes.The Planning Commission recommended that <br /> the City Council adopt the park dedication ordinance amendments in June of this year. The <br /> Council had followed the Planning Commission's recommendation,with the direction that the <br /> City Attorney review the amendments.The City Attorney provided the Council with comments <br /> regarding the amendments, and the Council remanded the Ordinance back to the Planning <br /> Commission to review those comments and address as needed. The Planning Commission has <br /> amended the Park Dedication Ordinance per recommendations by the City Attorney,who had <br /> subsequently reviewed and agreed with the changes made. <br /> RECOMMENDATION: THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDS <br /> THAT THE CITY COUNCIL AMEND THE SECTION 9.10 OF THE ORDINANCE REGARDING <br /> PARK DEDICATION AS FOLLOWS: <br /> i. In accordance with the provisions of Section 462.358 of the Minnesota Statutes, or <br /> amendments thereto, the subdivider shall dedicate, to the public, lands for highway <br /> rights-of-way, street rights-of-way, utility easements, wetland easements, and similar <br /> lands required for perpetual and public improvements. <br /> 2. The City of Pequot Lakes finds it in the public interest and necessary to provide future <br /> parks, trails and other public open and recreational spaces for the citizens of Pequot <br /> Lakes.As such,for every new subdivision of land involving three or more lots which are <br /> to be developed for residential purposes,the gily Council,with recommendation of _ Deleted:Planning Commission <br /> theXlannin-g Commission�shalI require a uayment or dedication to the City of any one of Deleted:concurrence <br /> the following,to be reviewed on an annual basis at the beginning of each calendar year: Deleted:city Council <br /> a. A reasonable portion of a land dedication for conservation purposes or for public <br /> use as parks,recreational facilities,playgrounds,trails,wetlands, or open space, <br /> up to o.o16 acres per resident expected in the proposed development,using the <br /> most recent average household size as determined by the Minnesota State <br /> Demographer's Office and the U.S.Census Bureau. <br /> b. A payment of up to$416 per expected resident in the proposed subdivision,using <br /> the most recent average household size as determined by the Minnesota State <br /> Demographer's Office and the U.S.Census Bureau. <br /> c.
