Mr. Andersen stated that the height of 40 feet is the worse case scenario; it will likely not
be that tall.
Public comment: None. (Someone in the audience commented on a fence for a highway
not being built. Chairman Woog reminded her that this is for a different application.)
Mr. Williams clarified that the request is for a Variance up to 15 feet,25 feet is allowed.
Color and screening was discussed, as well as signage. No signage is allowed on
accessory structures. Mr. Andersen stated he is not sure what the for will be. It would
depend if it is new or used. The Planning Commission stated ust collector is
OSHA required and will be visible from any roadway. The collector will be located
in the Industrial Park where these items belong. Mr. Hal po out that the dust
collector will not look like the architect's rendering o th ite pi
A motion was made by Tom Adams, seconded ark Hallan,to appr e Variance
for a structure up to 15 feet, as recommended ,basv on the follo dings
of Fact:
1. The proposed use meets the uired setbacks, the proposed structure being
at more than 30 feet from all p lines.
2. The proposed use meets the re rvious co a limit of 50%, with a
proposed 30%of the lot area as i ervio ce.
`., 3. The proposed cturing buil eets ding height limit of 25 feet,
being approxi .625 feet height measured by the Ordinance
standards. T ust co or,howeve easures 40 feet in height.
4. Strict inte r n of Ordinance d create an undue hardship on this
business, as the not able to operate in the City without the
re colle o me standards. Dust collectors are purchased
thir man ers and the dust collection unit that the applicants
quire is man ed aximum height of 40 feet. There is a 12.5 foot
ence from eak o e proposed manufacturing building to the highest
po the dust c tor.
5. Whil a are not y characteristics of the land itself that prevent this property
from be evel d with most other industrial uses, strict interpretation of the
Ordinance, case, would be impractical because of the pre-manufactured
height of a re fired unit for a wood-working industrial operation.
6. The deviation from the Ordinance would be in keeping with the spirit and intent
of the Ordinance, which is to limit the general height of structures for aesthetic
and fire safety purposes. This property, located in the Business Park, is
surrounded by similarly designed principle and accessory structures.
7. The variance, if granted, will not create a land use that is not permitted in the
zone. Manufacturing operations are permitted uses in the Light Industrial zone,
and were it not for the height of the dust collector, would otherwise be permitted
administratively.
Minutes 4
Pequot Lakes Planning Commission
August 16, 2007
