COMMUNITYGROWTH <br /> 1 N S T 1 T U T E <br /> July 30, 2007 <br /> Mayor and City Council <br /> City of Pequot Lakes <br /> 4638 County Road ii <br /> Pequot Lakes, MN 56472 <br /> Re: Planning Commission Report <br /> Dear Mayor and City Council, <br /> The Planning Commission met for their regularly scheduled July meeting at which they held two <br /> public hearings. The Planning Commission approved an after-the-fact conditional use permit <br /> request for shoreland grading, reviewed a policy, and reviewed an ordinance amendment for <br /> individual sewage treatment systems. <br /> The Planning Commission is forwarding the following recommendation for your consideration: <br /> HEARING: Ordinance Amendment to Modify Criteria Governing Individual <br /> Sewage Treatment Systems (ISTS), City of Pequot Lakes. Minnesota Rules Chapter <br /> 708o states in Section 7080.0305, Subpart i Compliance with this chapter. `All counties must <br /> adopt ordinances that comply with this chapter unless all towns and cities in the county have <br /> adopted local ordinances that also comply with this chapter and are as strict as the applicable <br /> county ordinance." <br /> Section 7080.0305, Subpart 2 A further states: "County ordinances must apply to all areas of <br /> the county other than cities or towns that have adopted local ordinances that comply with this <br /> chapter and are as strict as the county ordinance."The Pequot Lakes Land Use and Subdivision <br /> Ordinance is less restrictive than the Crow Wing County Zoning Ordinance governing Sewage <br /> Treatment Facilities. <br /> RECOMMENDATION: THE PLANNING COMMISSION RECOMMENDS THAT THE CITY <br /> COUNCIL AMEND THE ORDINANCE REGARDING CRITERIA OF INDIVIDUAL SEPTIC <br /> TREATMENT SYSTEMS AS FOLLOWS: <br /> 4.5 Building Standards. <br /> 6. Sewage treatment systems shall conform to Minnesota Pollution Control Agency <br /> Standards-Chapter 708o and Crow Wing County Zoning Ordinance Article 37. Further, <br /> all systems shall be designed, evaluated,installed and inspected by persons certified by <br /> the State of Minnesota. The City does not assume liability for the failure or malfunction <br /> of any sewage treatment system. <br /> and <br /> 7.7 Sanitation Standards. <br /> 2. Domestic Sewage. <br /> A. All plumbing shall discharge into a municipal sanitary system if available. <br /> B.
