8. The applicant has submitted a plat check completed by an independent Professional <br /> Land Surveyor. <br /> 9. At the time of this report's preparation, the applicant was in the process of obtaining a <br /> cost estimate to be inserted into the final development agreement and to be approved by <br /> the City Engineer. <br /> io. The Final Plat substantially agrees with the original layout in the preliminary plat. The <br /> layout of Trailside Road and the configuration of the lots in the western portion of the <br /> development has been modified slightly to fit the contour of the land and accommodate <br /> the changes in the road layout. <br /> ii. The City Attorney has agreed that all parties with an interest in the property are shown <br /> as signers of the document. <br /> 12. The City Engineer has submitted comments regarding the proposed improvements, <br /> indicating that there few remaining items that need to be addressed and a revised cost <br /> estimate provided. <br /> 13. At this time, financial security has not been posted as estimates for the required <br /> improvements are in the revision process. <br /> Planning Commission Direction: The Planning Commission should develop findings to <br /> either approve or deny the final plat. In general,the Commission cannot deny a final plat unless <br /> the applicant will not or cannot meet the final platting requirements or the conditions of the <br /> preliminary plat approval. The Commission cannot impose additional conditions that do not fall <br /> directly within the guidelines of the final plat or relate directly to conditions imposed in the <br /> preliminary plat. <br /> The Commission also has the option to table the final plat to obtain additional information. <br /> Staff Recommendation: The Staff expects that the items remaining to be accomplished for <br /> this plat will be addressed at the meeting on Monday, October 16, between Staff, the developer, <br /> and the developer's agents. Should the remaining items be resolved,the Staff would recommend <br /> approval of the final plat application for Trailside Estates. <br /> The Park Board will meet after this report has been prepared to review the proposed plat.
