Staff Findings: The Staff provides the following findings of fact for consideration by the <br /> Planning Commission: <br /> i. The proposed rezoning to Urban Residential would be consistent with the City's <br /> Comprehensive Plan which states that properties within close proximity to the <br /> downtown are suitable for an urban residential development pattern. <br /> 2. The proposed rezoning to Urban Residential is consistent with the Future Land Use <br /> Map,which designates this area as a future Urban Residential area. <br /> 3. The proposed rezoning to Urban Residential meets the compatibility requirements for <br /> the zone as the surrounding parcels are zoned a mix of Urban Residential and <br /> Commercial. <br /> 4. The subject property meets the purpose and intent of the Urban Residential zone as it <br /> would allow redevelopment to a more urban development within walking distance of the <br /> downtown. <br /> 5. The property meets the minimum lot size requirement for the Urban Residential zone as <br /> it is a total of 35.6 acres. <br /> 6. The property meets the minimum lot width standard of 50 feet for the Urban Residential <br /> zone. <br /> 7. Rezoning of the part of the property that is Multi-Family Residential to Urban <br /> Residential would not constitute a down-zoning as lot size and dimension standards are <br /> similar.The previous Ordinance did not provide a minimum lot size requirement. <br /> 8. Rezoning of the part of the property that is Light Industrial to Urban Residential could <br /> be perceived as a down-zoning even though it is actually more consistent with the <br /> surrounding zoning designations than its current designation. Rezoning to a <br /> classification that would make the existing,established land use non-conforming would <br /> limit the property owner's ability to expand operations or modify the operations in any <br /> manner. <br /> Planning Commission Direction: The Planning Commission can recommend that the City <br /> Council approve,deny,or table this rezoning. <br /> Staff Recommendation: Based on the findings of fact presented in this report, the Staff <br /> recommends that the Parcel # 29015i3ooHBAoo9 be rezoned to Urban Residential as it is <br /> consistent with the Comprehensive Plan and Future Land Use Map and is compatible with the <br /> surrounding properties which are zoned a mix of Downtown Mixed use and Commercial. The <br /> two southern parcels, while proposed to be rezoned to Urban Residential,should be rezoned to <br /> Light Industrial,to avoid down-zoning of the property. <br /> City of Pequot Lakes Staff Report 5-3 <br /> September 21,2oo6 <br />
