Minneapolis,MN 55418 RE: City of Pequot Lakes Potential Ordinance Violation PIN: 290152101N00009 Dear Mr. and Mrs. Karr: It has come to our attention that you have placed fill from your landscaping project on City right-of-way. As you are aware,there is a 10-foot strip of land platted as a street for public use that borders your property to the south. That use would not include placing fill from your lot. Any landscaping you do must be done entirely within your lot lines. The dirt that has been placed on the public right-of-way must be removed. In addition, the dirt has been placed on a steep slope without any erosion control. This dirt could potentially erode toward Sibley Lake. The Land Use Ordinance states, in Section 7.12, subpart 7,Erosion, that, "Erosion control measures shall be provided in all areas disturbed during any grading or construction. All areas disturbed shall be covered with topsoils and seeded Areas subject to concentrated runoff or steeper than 3:1 shall be sodded,planted with appropriate deep-rooted vegetation, or protected with an appropriate mulch cover as directed by the City Engineer. " This is a serious matter which we expect you to take immediate action to address. Upon receipt of this notice of violation, you must do the following: 1. Remove dirt in public right-of-way. 2. Immediately install appropriate silt fencing lakeward of this dirt. 3. Immediately provide temporary ground cover including mulch. 4. Either sod this area or plant with deep-rooted vegetation.
