�-' conformity to the adjoining land area. Four (4) inches of black topsoil shall be <br /> placed on all areas,except beaches,that will remain above water level. Haul roads <br /> will be restored to their condition prior to the beginning of the extraction <br /> operation. <br /> b. Vegetation. Vegetation shall be restored by appropriate seeds of grasses or <br /> planting of shrubs or trees in all parts of said mining area where such area is not <br /> to be submerged under water as herein above provided. <br /> c. Banks of excavation not backfilled. The banks of all excavation not backfilled <br /> shall be sloped not steeper than three (3) horizontal feet to one (1) vertical foot <br /> and said bank shall be seeded. <br /> In addition to meeting these criteria, a successful extractive use application must meet the <br /> criteria for a conditional use permit, as detailed in Section 11.6 of the Ordinance. This section <br /> indicates that there are four main criteria that must be met and an additional eight factors to be <br /> considered by the Planning Commission in making a decision on a conditional use permit <br /> application. <br /> At last month's meeting, the Planning Commission had indicated that the required distance <br /> from the OHW(Section 8.5,Subdivision 2E)should be 1,00o feet,while the Ordinance currently <br /> requires 200 feet.The working maps included in this report account for that 1,000-foot distance <br /> from the OHW. The distance from residential districts has also been increased from 1,00o feet <br /> to a half-mile.The resulting area available for the overlay district is indicated on these maps. <br /> During the discussion, the following criteria were discussed as a basis for developing an overlay <br /> district for extractive uses: <br /> 1. Proximity to residential uses <br /> 2. Visibility from roadways or main corridors <br /> 3. Separate extractive uses from accessory uses like processing <br /> 4. Restrict extractive uses to Forest Management and Agriculture zones <br /> 5. Inventory existing extractive uses in the City <br /> 6. Map potential sites of extractive uses <br /> 7. Buffer existing extractive use sites <br /> Four maps have been included in this packet for your discussion: <br /> 1. Map showing the proposed extractive use overlay district (l000 feet from residential <br /> districts)with the current zoning classifications. <br /> 2. Map showing the proposed extractive use overlay district (i000 feet from residential <br /> districts)with the aggregate resource potential. <br /> 3. Map showing the proposed extractive use overlay district(one half mile from residential <br /> districts)with the current zoning classifications. <br /> 4. Map showing the proposed extractive use overlay district (one half mile from residential <br /> districts)with the aggregate resource potential. <br /> In addition, the Staff has included Crow Wing County's Ordinance regarding extractive use <br /> applications. The County's ordinance distinguishes between different types of extractive uses <br /> and related activities, including a classification scheme, which is the largest difference between <br /> the County's and the City's respective ordinances.Article 29.2 of the County ordinance provides <br /> five classifications ranging from simple top soil removal and extraction to crushing to mixing <br /> plants. <br /> In the previous extractive use application, there was concern over the accessory uses proposed <br /> for the site, which including a mixing plant, crushing, and washing of materials.
