STAFF REPORT <br /> Item: Review of Environmental Assessment Worksheet for the RV Resort Village <br /> Background: Over the last month, the City held the public comment period for the <br /> Environmental Assessment Worksheet (EAW) for the RV Resort Village. Now that the public <br /> comment period is complete, the City must make a determination as to whether the preparation <br /> of an Environmental Impact Statement(EIS)will be necessary for this project. <br /> An EIS shall be ordered for projects that have the potential for significant environmental effects. <br /> Determining whether the project has potential for significant environmental impacts can be <br /> complex,but the Minnesota Rules require that the follow criteria be considered: <br /> 1. The type,extent, and reversibility of the environmental effects; <br /> 2. The cumulative potential effects of related or anticipated future projects; <br /> 3. The extent to which the environmental effects are subject to mitigation by an ongoing <br /> public regulatory authority; and <br /> 4. The extent to which the environmental effects can be anticipated and controlled as a <br /> result of other environmental studies undertaken by public agencies or the project <br /> proposer,including other EISs. <br /> The Planning Commission may find that there are environmental impacts that will result with <br /> the development proposal. These environmental impacts, however, may be adequately <br /> addressed and/or mitigated within the EAW, and so, taken alone, would not be sufficient <br /> grounds for requiring an EIS. The Planning Commission should take care to consider all four of <br /> the criteria listed above. <br /> In making this decision, written findings of fact supporting the City's decision should be <br /> prepared. These findings should include factual and legal reasons for the City reaching its <br /> determination. <br /> Once the determination has been made and the findings prepared, the City should draft a <br /> resolution for the Council to pass that supports the decision made by the Planning Commission. <br /> City of Pequot Lakes Staff Report <br /> Ju1y 20,2006 <br />
