The subject property is surrounded by properties that have been rezoned to Commercial <br /> to the north, Forest Management and Transition Residential to the west, and Forest <br /> Management to the south. <br /> 4. The Transition Residential Zone is compatible with the Forest Management,Agriculture, <br /> and Commercial zones. <br /> 5. The Agriculture Zone is compatible with Forest Management, Transition Residential, <br /> and Commercial zones. <br /> 6. The property was zoned Forestry under the previous Ordinance, which required a <br /> minimum lot size of io acres.The Transition Residential zone has a minimum lot size of <br /> 5 acres, while the Agriculture zone has a minimum lot size of 20 acres. The property <br /> owners are requesting to be down-zoned to the Agriculture classification. <br /> 7. The property meets the minimum lot size for both the Transition and Agriculture zones, <br /> being roughly 3o acres in size. <br /> 8. The Agriculture zone is more conducive for animal husbandry purposes than the <br /> Transition Residential zone. <br /> Planning Commission Direction: The Planning Commission can recommend that the City <br /> Council approve,deny,or table this rezoning. <br /> Staff Recommendation: The Planning Commission has the latitude to zone this property to <br /> either Transition Residential or Agriculture. While the Transition Residential zoning conforms <br /> to the Future Land Use map in the Comprehensive Plan, rezoning the property to Agriculture <br /> would not be in conflict with the surrounding land uses, nor would it conflict with the spirit and <br /> intent of the Comprehensive Plan. <br /> The property is located within the Potential Utility Service Area, as shown on the map on page <br /> 81 of the Comprehensive Plan, and this location is a requirement for the Transition Residential <br /> zoning classification. However, being in this service area does not require that the zoning <br /> classification be Transition Residential as is evidenced by other properties just to the south and <br /> east of the subject property that are of different classifications. <br /> The purpose and intent of the Transition Residential zone is to serve as a medium density buffer <br /> between areas of high density and areas of lower density. This particular property does not <br /> appear to be serving the purpose of buffering as the majority of the surrounding are of similar <br /> density characteristics. <br /> Based on the findings presented in this report and the preceding analysis,the Staff recommends <br /> approving the rezoning request and rezoning the property to Agriculture. <br /> City of Pequot Lakes Staff Report <br /> `'` March 16,2Oo6 3-3 <br />
