Office of the Land Commissioner
Thomas J.Cowell
lil 322 Laurel Street,Suite#12,Brainerd,MN 56401
9 218-824-1115
Fax 218-824-1070 wing mn.0
` V
F3 Tom.CowelI anco.crow- s' C O '!
7, WING:C )T ANT i
BRA INERQ,MINNESOTA 6640T "
March 28,2006
Dawn Bittner,Zoning Administrator
City of Pequot Lakes
4638 County Road I 1
Pequot Lakes,MN 56472
Re: Action to Withhold for Six(6)Months
In response to the City's disapproval of the County Board's action to classify tax forfeited lands to a"non-
conservation"status with intentions to sell in the future, the County Board took action on March 28,2006 to withhold
the tract(s)from public sale for a period of six(6)months in accordance with MS 282.01. The 6 month withholding
period is intended to give the city or town time to consider acquisition of the parcel(s)withdrawn from sale. The
tract(s)withheld is as follows:
Pequot Shady Shores,Lots 16-19,Block 17..(re:29107017016Z009)
According to MS 282.0 1, Subdivision 1,If the town or city`jails to submit an application and a resolution of the
board or governing body to acquire the property within the six month withholdingperiod, the county may offer the
property for sale upon expiration of the withholding period"
We now have six months to work out the details of an acquisition by the City of the tax forfeited property, above.
My questions to you are:
1. MS 282 does allow a direct sale to a governmental subdivision for a public purpose with County Board
approval. Please identify the City's intended public purpose for this tract.
2. Please indicate that the City is prepared to purchase the tracts at market value and is prepared to reimburse
Crow Wing County for all appraisal costs.
3. Please indicate that the City is prepared to pay all costs associated with the recording of the State Deed e.g.
state deed fee,state deed tax,county fee,3%assurance tax,recording fee.
Your attention to this matter within the six month withholding period is important. If arrangements have not been
made within the six month withholding period, the County is free to proceed with its sale plans. Please bring this
forward to the City Council for consideration.
If you have any questions concerning this process, please advise.
Sincerely
Thomas .CowVer
Land Commiss
AN EQUAL OPPORTUNITY EMPLOYER
