All road, erosion control, and drainage plans and specifications shall be prepared <br /> and certified by an engineer registered in the State of Minnesota with experience <br /> in underground utility, as well as road construction and municipal street design <br /> conforming to the Pequot Lakes standards for City maintained roads. <br /> Prior to the date of City authorization to proceed with commencement of construction of the <br /> described improvements, Developer must supply all documents referenced in this Agreement and <br /> pay to the City any and all outstanding expenses incurred by City for plat and other development <br /> purposes, including but not limited to engineering, legal, and other professional staff fees. <br /> D. Easement Right-of-Way Dedication <br /> The Developer shall dedicate to the City, at no cost to the City, all permanent or <br /> temporary easements for right-of-way purposes necessary for the construction and <br /> installation of the Developer's Improvements as determined by the City. All such <br /> easements and/or right-of-way required by the City shall be in writing, in <br /> recordable form, containing such terms and conditions as the City shall determine. <br /> Further, the Developer shall provide the City with all necessary permanent <br /> easements and/or right-of-way for maintenance of the Developer's improvements. <br /> E. Permits and Approvals <br /> The Developer shall be responsible for securing all site grading and development <br /> approvals and permits from all appropriate Federal, State, Regional, and Local <br /> jurisdictions prior to the commencement of the site grading or construction. All <br /> construction installation, materials and equipment shall be in accordance with the <br /> plans and specifications approved by the City. In addition, the Developer <br /> represents and warrants that all necessary permits from the "Minnesota Pollution <br /> Control Agency"have been obtained. <br /> II. Representations of Developer. As an inducement to the City's approval of the <br /> engineering specifications and authorization to proceed with construction and entering <br /> into this Agreement, the Developer represents and warrants to the City: <br /> 3 <br />
