i <br /> F. Adequate measures have been taken or will be taken to prevent or control offensive <br /> odor, fumes, dust, noise, and vibration, so none of these will constitute a nuisance <br /> \.. and to control lights and signs in such a manner,that no disturbance to neighboring <br /> properties will result. <br /> G. The conditional use will not result in the destruction, loss or damage of a natural, <br /> scenic or historical feature of major significance. <br /> H. The conditional use will promote the prevention and control of pollution of the <br /> ground and surface waters including sedimentation and control of nutrients. <br /> Staff Findings: The Staff provides the following findings of fact for consideration by the <br /> Planning Commission: <br /> i. The proposed use is an appropriate conditional use in the Downtown Mixed Use District, <br /> as Section 7.1, Subd. 6 indicates that conditional use permits are required for the <br /> proposed request. <br /> 2. The proposed use conforms to the Comprehensive Land Use Plan, which indicates that <br /> the City should encourage the clustering of businesses to enhance walkability in <br /> downtown and promote businesses that add to the City's distinct character. <br /> 3. The proposed use, with conditions, is unlikely to detract from the surrounding <br /> neighborhood as nearby properties are developed as retail businesses and also <br /> containing various methods of signage. <br /> 4. The proposed use would not be injurious to the public health, safety, or welfare as it <br /> would serve to direct traffic around the corner of the property. The proposed sign <br /> locations would not obstruct the view of traffic or impeded pedestrian corridors. <br /> 5. The proposed use is unlikely to be injurious to the use and enjoyment of other properties <br /> in the immediate vicinity as many neighboring properties are developed commercially. <br /> The additional directional sign would be placed near existing trees and landscaping. <br /> 6. The proposed use will not impeded the normal and orderly development of adjacent <br /> properties and the properties are already platted and mostly developed with <br /> �., retail/service businesses. <br /> 7. There are no additional public services or facilities required for the development of this <br /> property. <br /> 8. There are no additional vehicular approaches that are required for the proposed use <br /> besides what already exists on the property. <br /> 9. The proposed use does not require any additional parking. The applicant has provided <br /> parking sufficient to serve the existing business. <br /> io.The proposed use will not produce noise,dust,or odors at a level that would constitute a <br /> nuisance outside of the normal activities related to the placement of the signs. <br /> ii. The proposed use will not result in the destruction or removal or any natural,scenic,or <br /> historic sites of major significance as this property has already been developed. <br /> 12. The proposed use does not require any additional stormwater management measures. <br /> 13. The two`Type X signs are allowed and meet the provisions set forth in Section 7.1,Subd. <br /> 5A(4)• <br /> 14. The proposed additional sign(Type B)would have a total sign area of 16 square feet and <br /> be 4 feet high. <br /> 15. As the large concentration of businesses along Government Drive is to the south of Jay <br /> Street,it may be difficult to attract customers to north side of the subject property. <br /> 16. Alternatives to additional signage include no additional directory sign or notation <br /> indicating the location of businesses around the corner on the Type A signs. <br /> 17. The proposed additional sign would not be in conflict with signage in the area. <br /> 18. The proposed additional sign is unlikely to have negative aesthetic impacts because of its <br /> relative small size and surrounding landscaping. <br /> t9.
