Hendricks
Attorney at Law
P. O. Box 90
Pine River, MN 56474
Re: Stacey and Karin Simons
Dear Mr. Hendricks:
I presented your proposal to the Planning Commission at their regular monthly meeting
August 16, 2007 and their response to your August 2 letter is:
1. In reference to the mobile home, does Mr. Simons plan to remodel/repair it to sell
it or does he plan to keep it as extra living quarters on his property? If the former,
this would be classified as some type of Home Occupation or a commercial use
requiring a Conditional Use Permit. If the latter is the case, it would be an illegal
structure as it would not meet the minimum building standards and would need to
be removed. The Pequot Lakes Land Use and Subdivision Ordinance states in
Section 4.5, subpart 2,that "All dwelling units shall be a minimum of 20 feet
wide. . . "
2. In reference to the motor vehicles, the Planning Commission would like a
timeframe for their removal. No abandoned vehicles are allowed in the Rural
Residential zoning classification. Abandoned Motor Vehicle is defined as: "A
motor vehicle as defined in Minnesota Statutes Chapter 169.01 that. . . (c) has
remained on private property for more than thirty days and is inoperable or is
unlicensed unless kept in a garage or other storage structure. " Are the two snow
plows and the Chevy pickup licensed? The Planning Commission also suggested
enlisting Grant Walker's help in removing the parts cars. He can be reached at
Walker Salvage, 568-8294
3. In regard to the fence, the proposed fencing may not be adequate. The Planning
Commission preferred the rough-sawn lumber rather than pole barn metal. In
addition, your letter did not specify a proposed height. Fences in the Rural
Residential zoning classification may not exceed 60 inches, which may not
