i. The establishment of a fitness center (Curves) is an appropriate use in the Downtown <br /> Mixed Use district.A fitness center qualifies as Commercial Use,Other,which requires a <br /> conditional use permit in the DMU district. <br /> 2. The proposed use of a fitness center does not conflict with the Comprehensive Plan, <br /> which indicates the importance of the service sector of the business community. <br /> 3. The proposed use is compatible with the existing neighborhood, which contains other <br /> existing commercial establishments,such as a hair salon. <br /> 4. The establishment of a fitness center (Curves) is not injurious to the use and enjoyment <br /> of other property in the immediate vicinity, nor does it substantially diminish or impair <br /> values in the immediate vicinity. The fitness center will be located in an existing <br /> building;no new construction is needed. <br /> 5. The proposed fitness center is unlikely to be injurious to the use and enjoyment of other <br /> property in the immediate vicinity for the purpose permitted on the property, nor will a <br /> fitness center substantially diminish or impair values in the immediate vicinity. The <br /> activities of the proposed use will be contained within the existing building. <br /> 6. The fitness center will not impede normal and orderly development because the fitness <br /> center will be established in an existing commercial building. <br /> 7. The establishment of a fitness center will not have a detrimental impact on public costs <br /> for public facilities and services and will not be detrimental to the economic welfare of <br /> the community. The building is served by an existing on-site septic system and no <br /> additional utilities or public facilities are needed at this time. <br /> 8. The proposed use is unlikely to create an interference with traffic in the immediate <br /> vicinity. The building, parking area, and access to the property currently exist, and the <br /> proposed use is unlikely to generate excessive amounts of traffic for the infrastructure in <br /> place. <br /> 9. There are adequate measures to provide sufficient off-street parking and loading space. <br /> L. There is an existing gravel parking lot that can hold approximately 5 vehicles. Also, the <br /> parcel is located within the Downtown Mixed use District, anc�it;exempt from parking <br /> standards outlined in Section 7.10. <br /> io. There will be no offensive odors, fumes, dust, noise and vibration generated by this use <br /> (fitness center). The use requires no processing of materials to produce odors, fumes, <br /> dust,noise,or vibration. <br /> ii. There will be no loss or damage of a natural, scenic or historical feature of major <br /> significance because the use will occur within a preexisting commercial building. Since <br /> no new development is required there will be no loss or damage to any natural, scenic or <br /> historic features. <br /> 12. There are no groundwater or surface water pollution issues associated with this use. <br /> There will be no increase in impervious surfaces, no additional septic systems, or other <br /> actions related to this use that could be construed as a threat to the quality of <br /> groundwater of surface waters. <br /> Planning Commission Direction: The Planning Commission can recommend approval of <br /> the conditional use permit, recommend denial, or table the request if additional information is <br /> needed. If the recommendation is for approval or denial,findings of fact should be cited. <br /> Staff Recommendation: Based on the findings of fact presented in this report, the Staff <br /> recommends approval of the conditional use permit application. The Staff would also like to <br /> note that the placement of signage (installing a sign) requires a separate permit that can be <br /> obtained from the City of Pequot Lakes. <br /> City of Pequot Lakes Staff Report 1-3 <br /> September 20,2007 <br />
