STAFF REPORT
Agenda Item:6(a)Dan Helbling RV Resort
Background: The Conditional Use Permit for the RV Resort was approved in August of 2006.
That CUP included the following conditions:
1. The submitted plans shall be constructed as presented. Any alterations shall be
discussed with Zoning Staff prior to construction. If the staff feels the alteration is
significant,it shall go to the Zoning Board for review prior to proceeding.
2. Prior to occupancy of the property, the property owner shall notify the City Zoning
Office so that an inspection of the lighting can be performed. Lighting shall meet the
standards for glare and illumination contained in the Ordinance.
3. Improvements to Hurtig Road shall be completed within 12 months of
Conditional Use Permit approval as per the direction of Mike Loven,or
his representative, with the City of Pequot Lakes.
4. Improvements to County Road 168 shall be constructed within 12 months
of Conditional Use Permit approval as per the requirements of the Crow
Wing County Highway Department.
5. Improvements to Highway 371 shall be made as per the direction of Mn/DOT.
6. The resort shall develop an internal permitting process to monitor improvements to
the sites that would increase the amount of impervious coverage. Overall impervious
coverage shall not exceed an average of 1,500 square feet per site. The location of
impervious areas shall not be allowed to exceed the design standards for any of the
drainage areas. A report on impervious coverage shall be submitted to the City
annually for review. This program shall be established within the covenants for this
development. The covenants, including this program, shall be reviewed during the
final plat process and shall be modified at that time as per the direction of the
Planning Commission.
7. The applicant shall pay for the City's expenses for processing this application within
3o days of this approval or prior to filing for a final plat, whichever is sooner.
At this point, conditions three and four have not been completed, or even started, and the
developer, Dan Helbling, has had no contact with the City to request an extension. Section 7.6,
Subdivisions 7 and 8 state the following in regards to CUP's:
7. Violations of the conditions of a Conditional Use Permit shall automatically
suspend the permit. A review of the violation shall be conducted by the Planning
Commission. The Planning Commission shall determine conditions for
reinstating the permit or revocation, if applicable.
8. Failure by the owner to act on a Conditional Use Permit within 12 months, or
failure to complete the work under a Conditional Use Permit within 2 years,
unless extended by the Planning Commission, shall void the permit. A second
extension shall require a new public hearing. This provision shall apply to any
Conditional Use Permit outstanding at the time of the Ordinance adoption.
It should be noted that work on the project itself appears to have stalled and therefore there is
no immediate necessity for the improvements. We have asked Mr. Helbling to be at the meeting
to brief the Commission and discuss alternatives for moving forward with the permit.
City of Pequot Lakes Staff Report 1-1
December 13,2007
