STAFF REPORT <br /> Item: ISTS Ordinance <br /> Agenda Item:8(a) <br /> Background: Minnesota Rules Chapter 708o states in Section 7080.0305, Subpart 1 <br /> Compliance with this chapter. `All counties must adopt ordinances that comply with this <br /> chapter unless all towns and cities in the county have adopted local ordinances that also <br /> comply with this chapter and are as strict as the applicable county ordinance." <br /> Section 7080.0305, Subpart 2 A further states: "County ordinances must apply to all areas of <br /> the county other than cities or towns that have adopted local ordinances that comply with this <br /> chapter and are as strict as the county ordinance." <br /> Pequot Lakes Land Use and Subdivision Ordinance is less restrictive than the Crow Wing <br /> County Zoning Ordinance governing Sewage Treatment Facilities. <br /> Ordinance Amendment Proposal: Staff proposes the following amendments to Section 4.5 <br /> and 7.6 governing sewage treatment systems(additions are underlined and deletions are <br /> stricken): <br /> 4.5 Building Standards. <br /> 6. Sewage treatment systems shall conform to Minnesota Pollution Control Agency <br /> Standards-Chapter 708o and Crow Wing County Zoning Ordinance Article R7. <br /> and <br /> 7.7 Sanitation Standards. <br /> 2. Domestic Sewage. <br /> A. All plumbing shall discharge into a municipal sanitary system if available. <br /> B. All designs shall be submitted on Crow Wing County forms. <br /> C. All dwellings or structures with plumbing shall be served by an individual or <br /> common sewage disposal system meeting the requirements of MPCA Rules Chapter <br /> 708o and Crow Wing County Zoning Ordinance Article y. <br /> D. All non-conforming systems shall be brought into conformance. <br /> E. Sewage tanks being abandoned shall be thoroughly pumped and filled with soil. <br /> F. All owners of existing individual sewage treatment systems shall have the system <br /> inspected once each fWe three years by a certified sewage system inspector. New <br /> individual sewage treatment systems shall require an inspection five years after <br /> installation and every three years thereafter. <br /> i. The person inspecting the system shall examine the septic tank and <br /> determine the need for pumping in accordance with State Rules Chapter <br /> 708o and Crow Wing County Zoning Ordinance Article.,17. <br /> ii.
