June 29, 2007 SIDS <br /> rErTHH <br /> NOLTING <br /> Ms. Dawn Bittner, Zoning Admin. <br /> City of Pequot Lakes <br /> 4638 County Road 11 <br /> Pequot Lakes, MN 56472 <br /> Re: Pequot Lakes, MN <br /> Trailside Estates <br /> WSN No. 0130B0034 <br /> Dear Dawn: <br /> As you requested, we have reviewed Mr. Smith's June 8, 2007 letter to the City Council <br /> requesting a 60-day extension of the original June 30, 2007 completion date in the Development <br /> Agreement between the City and Mr. Smith for the Trailside Estates project. <br /> Per Article XVIII of the Development Agreement, as City Engineer, we have no objection to the <br /> requested extension to August 29, 2007. <br /> All parties should note several things about this granting of an extension of time: <br /> • The Developer needs to continue, as he has been, to progress towards completion. <br /> • Due to the weather at this time of year, the Developer will need to use water for various <br /> aspects of construction. <br /> • The City's costs (WSN's and Landecker's construction phase services are two that I <br /> know of), which per the Development Agreement are to be borne by the Developer, were <br /> based on this original June 30, 2007 completion date. Time is money and I anticipate <br /> that with this extension, these will be higher than originally estimated. I know that right <br /> now, even with some construction, I'll call them, "hiccups", WSN is close but slightly <br /> under our original estimate. Landecker is contracted directly with the City, so I do not <br /> know their cost status, although it should come as no surprise that they may be going <br /> over their original estimate as they have been doing the bulk of the field observation— a <br /> very time and construction progress dependent task. <br /> Sincerely, <br /> WIDSETH SMITH NOLTING &�ASSOC., INC. <br /> Timothy M.
