The Ordinance sates, in Section 11.8.1,that "Land Use Permits shall be issued for all new structures. . . No Person shall. . . construct any structure prior to applying for and receiving a land Use Permit. " I have been to your property and taken the enclosed pictures. If these pictures accurately depict your property, I would have to find that you are in violation of this provision of the Ordinance. I have enclosed a Land Use Application form Please complete the application and return no later than July 20,2007, including all items highlighted on pate 1. The after- the-fact fee will be determined by the Planning Commission after receiving the application and supporting information. Failure to make application by July 20, 2007, will prompt us to take more aggressive action. This would likely include Administrative Fines for each day the violation continues, civil action to obtain a court order directing you to comply with the Ordinance and could potentially include criminal action. You will also be responsible to reimburse the City for any expenses incurred in remedying this violation. This would include any consultant fees or other professional services that City Staff determines is necessary, including but not limited to the City Planner at $69.00 per hour,the City Engineer at $88.00 to $140.00 per hour or the City Attorney at$135.00 per hour.
