STAFF REPORT <br /> Application: Conditional Use Permit for Grading up to 50 Cubic Yards within the Lake <br /> Setback—AFTER THE FACT <br /> Applicant: John Lopez&Laurie Hauck <br /> Agenda Item:3(a) <br /> Background: Staff received reports of a significant grading operation on the property on East <br /> Twin Lake owned by John Lopez and Laurie Hauck. Upon investigation, it was determined that <br /> grading in excess of io cubic yards had taken place. The grading removed property adjacent to <br /> the existing dwelling between the dwelling and the lake, exposing the basement block. A cease <br /> and desist order was issued. <br /> After the time the cease and desist order was issued,the dwelling was modified to create a door <br /> to access the portion of the property that was excavated. Although this modification did not <br /> require a land use permit, it creates a situation where restoration of the property becomes more <br /> problematic since a full restoration would block the new door. <br /> - o <br /> �a <br /> ..• <br /> �. ler or construdion. N <br /> The property owners have now requested a conditional use permit for the grading and the <br /> construction of a boulder retaining wall. They have indicated that they intend to hydro seed the <br /> yard. This application was submitted on June 18`x'2007. <br /> The property in question is located at 27623 County Road 107 in Pequot Lakes. The parcel is <br /> adjacent to East Twin Lake, a general development lake, and is located within the Shoreland <br /> Residential District (SR).
