STAFF REPORT <br /> Items Valerie Dwight,Construction without a Permit <br /> Land Use Application 07-75 <br /> Agenda Item:6(b) <br /> Background: Applicant has a parking pad that was approved by the Crow Wing County Soil <br /> and Water Conservation District on a Type 7 Wetland. Applicant has built decking on two sides <br /> of the parking pad, along with a stairway down to the walking path to the lake (see photos). <br /> Applicant did not apply for or receive a Land Use Permit for this deck construction. <br /> In 2005, Staff noticed a storage building had been placed on the lot. At that time, Applicant <br /> advised Staff that this was a fish house that would be used for storage in the summer. This <br /> plastic building has an expired Shelter Tag displayed. <br /> Applicable Ordinances: <br /> Section 11.8,subpart 1, Land Use Permits,states,in part,that"Land Use Permits shall be issued <br /> for all new structures. . .No person shall. . .construct any structure prior to applying for and <br /> receiving a Land Use Permit." <br /> Section imo, Fees, states, in part, `All late applications shall require the payment of an after- <br /> the fact fee as outlined in the fee schedule." <br /> The City of Pequot Lakes 2007 Land Use Fee Schedule states: "AFTER THE FACT FEES <br /> FOR PERMITTED STRUCTURES—5 times base fee(included)with a minimum penalty of <br /> $300.00." <br /> The City of Pequot Lakes 2007 Land Use Fee Schedule states: "Minimum Permit Fee:$125.00." <br /> Request: <br /> 1. Direct Staff to issue an after-the-fact Land Use Permit for this deck construction and <br /> include the storage building on the permit. <br /> 2.
