STAFF REPORT <br /> Item: Administrative Fines&Fine Designation on Fee Schedule <br /> The Police Department has suggested amending the definition of Nuisance in Section III and the <br /> verbiage of Section 12.1 as indicated on the following page. <br /> The Police Department has also drafted a proposed Resolution for the issuance of <br /> Administrative Fines. This would not need a Public Hearing,just passage by the City Council. <br /> Our administrative offences would be included with their offences, in alphabetical order. The <br /> penalty amount of$1oo.00 for our offenses is 1/10th of the State amount of$1,000.00. <br /> We will need to develop a policy to follow on all zoning violations which will be followed with <br /> Administrative Fines. The City Council will need to approve this policy. We must be consistent. <br /> Some considerations: <br /> 1. City Staff will issue a violation letter, similar to those issued in the past, giving the <br /> property owner a date to remedy the violation. This letter will state that if violation is <br /> not brought into compliance by the specified date, the Police Department will issue an <br /> Administrative Fine in the amount of$1oo.00. <br /> 2. The property owner will have 10 days in which e fine or request a hearing. <br /> 3. If the property owner fails to pay the penalty er &quest a hearing, a misdemeanor charge <br /> will be brought against the offender. If after a hearing is held and the property owner is <br /> found in violation,a State citation will be issued. <br /> 4. In the event a party is charged with a subsequent administrative offense, within twelve <br /> months for the same or substantially similar offense, the subsequent administrative <br /> penalty shall be increased by 25%. <br /> 5. The penalties collected will be deposited into the City's General Fund as a designated <br /> revenue fund for(land use education)such as: <br /> A. Printing brochures; <br /> B. Mailings; <br /> C. Publish articles in local newspaper; <br /> D. Other; <br /> E. Other; <br /> F. Other. <br /> Staff is looking for direction with the following: <br /> 1. Amount of time for each type of offense to be remedied; <br /> 2. Only one letter per offense; <br /> 3. Acknowledge progress and extend timeframe for completion; <br /> 4.
