Our staff has recently visited the site and documented <br /> that restoration work remains uncompleted. The payment that you owe to the City to <br /> cover the costs of enforcement remains unpaid. Correspondence with your attorney has <br /> not resolved this situation. <br /> The City is prepared to take legal action to enforce compliance with the City's Land Use <br /> Ordinance which may include criminal prosecution or injunctive relief either of which <br /> will include a request for recovery of the City's costs and expenses. <br /> We are requesting that you attend the February 15, 2007 Planning Commission meeting <br /> to discuss the situation with the City. We would seek at that meeting to reach a mutually- <br /> agreeable resolution for completion of the restoration project including a deadline for <br /> completion, as well as reimbursement of the City's costs and expenses associated with <br /> enforcement of the City's Land Use Ordinance. <br /> If you are unwilling to attend the meeting or otherwise make arrangements to meet <br /> directly with the City and resolve these issues, we are prepared to seek a court order <br /> which among other things would provide the City with the authority to complete the <br /> restoration as a means of abating the nuisance. <br /> Our meeting on February 15 begins at 7:30 p.m. and you will be placed first on the <br /> agenda. If you do not attend the meeting or make other arrangements to meet by this <br /> time, on February 15 we will authorize all action necessary to satisfactorily resolve this <br /> situation. <br />
