the workmanship of Developer Improvements for a period of one year following City's <br /> acceptance of the same for utility or maintenance purposes ("Guarantee Period"). The <br /> security described herein shall remain in place until all applicable warranty and <br /> guarantee periods have expired. <br /> The Developer shall repair or replace, as directed by the City and at the Developer's <br /> sole cost and expense, any work associated with and/or materials that become <br /> defective, in the sole but reasonable opinion of the City or its Engineer, provided that <br /> the City or its Engineer give notice of such defect to Developer within three months <br /> following the end of the Guarantee Period. The Developer, or Developer's contractors, <br /> shall post maintenance bonds or other security acceptable to City to secure these <br /> warranties. <br /> XVI. Inspection of Developer Improvements and Construction Observation. <br /> Developer authorizes the City and City Engineer to inspect construction of the <br /> Developer Improvements as required by the City and City Engineer and grants to them <br /> a license to enter the Development to perform all necessary work and/or inspections <br /> deemed appropriate during the construction of Improvements until final certification of <br /> acceptance or completion is approved by City for all Developer Improvements and <br /> expiration of any applicable warranty period. <br /> The City Engineer shall be notified of and inspections by the City Engineer shall take <br /> place based upon completion of the following schedule: <br /> • Clearing <br /> • Grading/shaping <br /> • Class V base construction <br /> • Bituminous pavement construction <br /> • Sanitary sewer installation. <br /> • Sanitary sewer connection. <br /> • Lift Station Startup <br /> • City water supply installation <br /> • City water supply connection/installation of City approved meters <br /> The City Engineer's review of construction at these stages shall be to observe <br /> compliance with the City standards and approved plans. The Developer's Engineer <br /> shall be responsible for conducting regular inspections, coordinating testing, and <br /> resolving construction related issues throughout construction culminating in submittal of <br /> written certification that construction has been completed in accordance with the <br /> approved plans and specifications. <br /> Inspections by the City are to be logged and reported to Developer. The cost of the <br /> inspections and observation by the City Engineer shall be paid by the Developer on a <br /> monthly basis. Further construction observation shall be logged on a daily basis with a <br /> written weekly report provided to the City and City Engineer. <br /> 9 <br />
