`-' 7. Both lots meet the minimum buildable lot size of 20,000 square feet in the C zone,with <br /> Tract A being 63,647 square feet and Tract B being nearly 7 acres. <br /> 8. All lots meet the minimum lot width of 50 feet, with Tract A being over 200 feet wide <br /> and Tract B being over 500 feet wide. <br /> 9. All the lots meet the impervious coverage limit of 25% for the Commercial zone, with <br /> Tract A having approximately 22% coverage with the proposed driveway included and <br /> Tract B currently having about 17%coverage. <br /> 10. The proposed lot layouts are compatible with the existing layout of adjoining properties <br /> and the proposed lot lines are parallel and perpendicular to existing lot lines. Future <br /> development will not be constrained by the proposed lot layouts. <br /> 11. The proposed side lot line is at right angles to the existing road line and the property line <br /> of the adjacent property. <br /> 12. Tract B meets the minimum frontage on public right-of-way requirement of 33 feet, <br /> having more than 500 feet. <br /> 13. Tract A does not have frontage on a public right-of-way, but rather proposes to access <br /> Oleson Street to the north. Oleson Street, while maintained by the City to a point <br /> extending to the south as noted on the survey, is not contained on public right-of-way <br /> near this property. <br /> Planning Commission Direction: The Planning Commission can approve the metes and <br /> bounds subdivision, it can develop findings to deny the metes and bounds subdivision, or it can <br /> table the subdivision request to gather additional information on which to base a decision or to <br /> provide the applicant time to modify the proposal. <br /> Staff Recommendation: The City has sought to avoid creating properties that do not have <br /> permanent access. By providing permanent access via a public right-of-way, the City and future <br /> property owners can avoid issues that typically arise over access rights and maintenance when <br /> neighbor disputes arise.While the proposed lot split does meet a number of criteria required for <br /> subdivisions, the Staff cannot recommend that the application be approved. If Oleson Street <br /> were located on a public right-of-way, to which the proposed Tract A were adjoining, then the <br /> proposed subdivision would meet all of the required subdivision standards. <br /> City of Pequot Lakes Staff Report 4-3 <br /> March 15,2007 <br />
