2. Does the Final Plat or Final Condominium Plat agree with the Preliminary Plat or <br /> Preliminary Condominium Plat? <br /> 3. Does the City Attorney agree that all parties with an interest in the property are shown as <br /> signers of the document? <br /> 4. Does the City Engineer agree that all improvements required are satisfactorily completed <br /> or are guaranteed by contract with adequate financial security? <br /> 5. Does an independent Professional Land Surveyor agree that the final document meets <br /> the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings: The Staff provides the following findings of fact for consideration by the <br /> Planning Commission: <br /> 1. The applicant has not yet provided evidence that a deed restriction has been placed on <br /> Lot One to limit access to the southern 75 feet of the parcel. The City Attorney has <br /> recommended that the applicant record a covenant to this effect, and has offered with <br /> assistance if needed. <br /> 2. The Final Plat agrees with the Preliminary Plat,with no changes having been made to the <br /> lot sizes,dimensions,or layouts since Preliminary Plat approval. <br /> 3. The City Attorney agrees that all parties with an interest in the property are shown as <br /> signers of the final plat document. <br /> 4. The applicant has not proposed improvements beyond what already exists to access the <br /> property, and so completion of improvements or financial security are not required for <br /> this application. <br /> 5. The applicant has submitted a plat check, showing that an independent Professional <br /> Land Surveyor agrees that the final document meets the statutory requirements. <br /> 6. As additional improvements were not proposed or required for this property, financial <br /> security to ensure the completion of improvements was also not required. <br /> 7. The Park Board has recommended that the applicant pay a park dedication fee of <br /> $4,224.00,based upon the recent discussion and formula for calculating park dedication <br /> fees.This fee is due at the time of filing the final documents. <br /> Planning Commission Direction: The Planning Commission may approve or deny the final <br /> plat. Findings of fact should be noted in either case. Should the Planning Commission choose to <br /> table the application, direction should be provided on the additional information needed on <br /> which to base a decision. <br /> Staff Recommendation: Based on the findings of fact presented in this report,the Staff only <br /> recommends approval of the final plat if the applicant has shown evidence of complying with the <br /> condition placed on the preliminary plat. <br /> City of Pequot Lakes Staff Report 1-2 <br /> March 15,2007 <br />
