COMMUNITY GROWTH cry op <br /> H S T i T u T E Pequot <br /> Experts in Small Town Planning ukips. -_ <br /> STAFF REPORT <br /> Application: Conditional Use Application <br /> Applicant: Tanya McDermott <br /> Agenda Item: 3(a) <br /> Background Information: The applicant's property is located at 4284 Woodman. <br /> Specifically, the S 1/2 of Lot 3 &all of Lot 4, Block 4, ist addition to Cole's plat of Pequot <br /> Lakes, PIDs: 291O3O040O3Boo9, 291030040040009. <br /> The applicant is proposing to replace the existing house on the property in questions <br /> with a single level orthodontic clinic, utilizing the existing house's foundation or a <br /> portion of the existing foundation. The applicant indicates that they will use the existing <br /> water and sewer connections that currently serve the existing house. <br /> The applicant has indicated that they will replace the existing landscaping with new <br /> landscaping once the office (orthodontic clinic) is completed. Additionally, an off-street <br /> parking area with be sited on the property.The applicant has also indicated that they will <br /> install signage on the property in congruence with the appropriate performance <br /> standards for signage located in the Down Town Mixed Use zone. <br /> Adjacent properties uses are: daycare/tanning complex, residential house, open parking <br /> lot,&the TDS property. <br /> Applicable Regulations: The following regulations apply to this application: <br /> Section 11.6, Subdivision 4. <br /> 1. The following must be met: <br /> A. The use or development is an appropriate conditional use in the land use <br /> zone. <br /> B. The use or development, with conditions, conforms to the comprehensive <br /> land use plan. <br /> C. The use with conditions is compatible with the existing neighborhood. <br /> D. The use with conditions would not be injurious to the public health, safety, <br /> welfare, decency, order, comfort, convenience, appearance or prosperity of <br /> the City. <br /> 2. The following must be considered: <br /> A. The conditional use should not be injurious to the use and enjoyment of other <br /> property in the immediate vicinity for the purpose permitted on that <br /> property, nor substantially diminish or impair values in the immediate <br /> vicinity. <br /> B. The conditional use will not impede the normal and orderly development and <br /> improvement of surrounding vacant property for uses predominant in the <br /> area. <br /> C. The conditional requirements at public cost for public facilities and services <br /> and will not be detrimental to the economic welfare of the community. <br /> D.
