© MUNIT Y .TROWTH city of <br /> I N S T I T U T E Pequot <br /> Ftlxrris in.Sinall Tcawn Planning & <br /> ineligible for a one-time addition under Section 17-4.4, Subpart 4, Nonconforming <br /> Structures and Uses. <br /> The applicants are trying to qualify for the one-time addition by removing all of the <br /> construction done under the prior variance and then apply the one-time addition <br /> requirements to the original structure. <br /> If the Planning Commission opts to consider that approach, the following conditions <br /> should be applied to the approval: <br /> 1. The size of the addition shall not exceed fifty percent of the size of the <br /> structure it is being added to. <br /> 2. For reasons of structural integrity, a basement may be allowed under the <br /> addition only where a basement existed in the original structure. <br /> 3. Additional screening is provided to screen the addition as viewed from <br /> adjacent properties, public roads and the surface water. <br /> 4. A stormwater management plan is implemented that directs stormwater <br /> away from adjacent properties and surface waters. <br /> 5. The height of the addition shall not exceed the height of the existing <br /> structure. <br /> 6. Beyond minor alterations needed to accommodate the addition, no <br /> structural modifications shall be made to the original structure. <br /> It is especially important the applicant understand the Condition #6 would prohibit <br /> reconstruction of the existing dwelling. <br /> While it is understandable that the property owner would want to keep the existing <br /> setback, which provides a unique and intimate experience with the lake, the City is not <br /> compelled in this instance to provide for an increase in that use. There is ample room on <br /> this property to construct a fully conforming dwelling. Reconstruction of the existing <br /> dwelling combined with an addition would not be consistent with the provisions of the <br /> Ordinance.
