No person shall. . . construct any <br /> structure prior to applying for and receiving a Land Use Permit. " In-ground steps <br /> were constructed without a Land Use Permit. <br /> The Ordinance further states, in Section 7.9, subpart A, Vegetation Removal that "No <br /> vegetation shall be removed along the shoreline, within shore impact zones, on steep <br /> slopes, and within bluff impact zones, except in conjunction with an approved site <br /> preparation or land alteration permit to accommodate the placement of stairways, <br /> landings, access paths, or authorized shoreland alteration. " Vegetation was removed <br /> in the Shore Impact Zone to construct steps without an approved site plan or land <br /> alteration permit. <br /> The Ordinance further states, in Section 7.13, subpart 1.D, Grading that "The following <br /> activities must be authorized by permit. . . Any alterations of the natural topography <br /> when the slope of the land is toward a public water or watercourse involving the <br /> movement of more than 10 cubic yards of material. . .in the shore impact zone or more <br /> than 50 cubic yards of material anywhere else within a shoreland area " In excess of 10 <br /> cubic yards of material may have been removed to construct steps and beach area. <br />
