18 additional units. The wastewater treatment facility is designed forl6,250 gallons per
day. The MPCA will make final permit approvals.
PUBLIC COMMENT:
Ann Beaver, 26834 Pine Acres Road,Nisswa, President of the Cullen Lakes Association:
Page 2 of Staff Report, is there a requirement for owners to put units in rental pool and be _
made available? They are to be in a rental pool, but it does not state a number of days
they have to be available for rent. Page 6, Findings of Fact 36 & 37,please clarify what
area is being referred to. Mr. Marohn stated the Staff Report should be western shore, —
not eastern shore. Mrs. Beaver also stated that Finding of Fact 37.the PUD allowed 34
mooring sites, but 40 were approved. Mr. Marohn stated that this is fhe exact Finding
from the last CUP. We used commercial density to determine.number of slips at 40. —
Cullen lakes Assoc has no objection to the relocation of tle Iots :along as the density in
the tiers is not increased, or to the lodge facility. For the constructh:of storage area, we
feel it would be a nice thing if you considered a 50' buffer. —
With regard to the suggested conditions of approval, we stro ugly urge you'Oplude
Conditions 10- 12 that has to do with the moorings,as well'ax 15 - 17,things we have --
felt strongly about since 2005. If they were not included,we would be strongly opposed
to this application. Regarding the beach, or second beach;-the CUP application includes a
phrase to create a second beach. The g .Report states only plans to expand existing
beach. We strongly oppose the second beach:h.r environmental reasons. In 2003 all
parcels on the Cullen Lakes were photographed ftopn the lake;'(Mrs. Beaver presented -
photos for our records.) In.March, 2005 wt xevorted illegal clearing of vegetation along
that peninsula(Mrs. Beaver presented photo'for our records) The City disagreed with
our assessment at that time. The:City thought otherwise. In November, 2007, a second
beach had been created-;W,ong t1wt shoreline. (Mt's'Beaver presented photos for our —
records) Mrs. Beaver qit-gtipned hye the City:'-'accepted the CUP application when the
applicant is,in violation for the consffii6 ,6,'Of that second beach. Chairman Woog stated
that the City is aware Of that violation. CLA attended site visit. Applicant altered the —
shorellne without a permit Mrs Beaver stated that the applicant did request the second
beach. The,Staff Report needs to be more clear. The Staff Report could say a second
beach is not approved with this application. May, 2007 DNR conducted vegetation —
survey and part of survey indicated shoal substrates and at that second beach area the lake
bottom is silt and marl, no natural sand. The LCA is very strongly opposed to the second
beach. For restoratip wof beach area, we suggest contacting Beth Hippert at SWCD. —
Mr. Williams asked regarding the photos around lake, what is water level today? Mrs. _
Beaver stated it may be down a foot, not more.
Paul Reichenbach, 27188 Sarah Lane: The proposed lodge and wellness center-will —
they have a paved parking lot? Mr. Miller stated there would be a paved parking lot.
Will it be visible from lake? Mr. Miller stated it would not be visible from the lake. Mr.
Reichenback stated that he recently looked at the website for Wilderness and they are —
already advertising the storage facility, lodge, 2 beaches, etc. He also asked when the '1
DNR determines docks for boating, are they going to look at docks for swimming also.
Minutes 2 —
Pequot Lakes Planning Commission
April 17, 2008
