9. The Rural Residential Zone is compatible with Forest Management, Recreation,
Agriculture, and Transition Residential zones, although cannot be surrounded by
Forestry and Agriculture.
10. The property was zoned Rural Residential under the previous ordinance and had a
minimum lot size of 5 acres, and the new Rural Residential lot minimum size is
the same. Therefore the proposed rezoning would be an equal lot size minimum
requirement from the previous zoning classification and will not result in a
downzoning.
11. The property meets the minimum lot size for the Rural Residential zone, being
roughly 10 acres in size. The property meets the minimum lot width for both
street frontages in the Rural Residential zone, being over 200 feet wide on both
sides.
12. Representation of the applicant has failed to develop findings to support his
client's request to zone it commercial.
Mary Pfeiffer stated that the applicant is very sick in Mayo Clinic waiting for a
transplant.
The Planning Commission stated that Ms. Watt has hired an attorney as representation.
He has not given any finding why it should be commercial.
All members voted"aye". Motion carried.
APPLICANT: City of Pequot Lakes
Applicant requests an Ordinance Amendment to Increase Accessory Structure Size
in the Shoreline Residential Zone.
Ms. Barajas explained the Staff Report.
A motion was made by Bill Habein, seconded by Mark Hallan,to recommend the City
Council amend Section 5.8, Subdivision 4, J as stated defined in the Staff Report. All
members voted"aye". Motion carried.
APPLICANT: City of Pequot Lakes
Applicant requests an Ordinance Amendment Establishing an Extractive Use
Overlay District.
Mr. Adams and Ms. Barajas explained the discussion from last month and the Staff
Report. The Planning Commission suggested using the road to cut off the overlay along
the north side of Section 12. The area would then be defined on the south by Akerson
Road, the east by Nelson Road and the north by Wild Acres Road.
Staff was directed to look at criteria for a CUP and bring to the December meeting.
Section 8.5 needs to be tightened up.
Planning Commission Minutes 4
November 16, 2006
