5. Lots 3 meet the minimum lot size and width standards for the Shoreline <br /> Residential zoning district, both having more than one acre of area and having <br /> more than 100 feet of shoreline at the OHW and the building line. <br /> 6. Lot 1 and Lot 2 do not meet the minimum lot size of 2.5 acres for the Shoreline <br /> Commercial zone, being approximately 1.7 acres in size. The property is also <br /> does not meet the minimum lot width of 300 feet, being roughly 200 feet wide. <br /> 7. Rezoning Lot 1 to Shoreline Residential would make the existing resort a non- <br /> conforming use in the zoning district as resorts are specifically excluded from the <br /> Shoreline Residential District. <br /> 8. Should Lot 1 be rezoned to Shoreline Commercial, the existing resort would not <br /> be non-conforming, as resorts are listed conditional uses in this zone. The <br /> property would be considered a non-conforming property due to lot size,though. <br /> 9. Rezoning Lots 3 to Shoreline Residential would meet the compatibility <br /> requirements for that zone, being that they both are adjacent to a lake and are <br /> developed as residential properties. <br /> 10. Rezoning Lot 1 and Lot 2 to Shoreline Commercial fulfills the purpose and intent <br /> of that zoning classification in that is maintains a zoning classification for existing <br /> commercial, recreationally oriented uses within the shoreland area. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests to Rezone from Forestry to Forest Management. John and <br /> Nancy Brunes, property owners. Parcel Identification Number: 290032204000009, <br /> 290032103A00009,290032300000009,290032400000009,290033200000009, and <br /> 290033100000009. <br /> A letter dated September 18, 2006 had been received from John and Nancy Brunes and is <br /> attached hereto and made a part of these Minutes. The letter requested the top 2 parcels <br /> be rezoned to Commercial. Mr. Habein pointed out errors on page 2 of the letter. He <br /> stated that TIF was the reason the property for the AmericInn was annexed into the City <br /> of Jenkins. Sibley Township had approved construction of the motel, but could not <br /> participate in any TIF. <br /> Mr. Williams stated he felt that some of these parcels could be zoned Commercial at <br /> some future time, but not now. He would like to see what is planned, along with a <br /> topographic survey including wetlands. Growth to the west will be allowed to happen at <br /> some point,but with no plans, he cannot recommend a commercial zoning classification. <br /> A motion was made by Mark Hallan, seconded by Tom Adams,to recommend rezoning <br /> the 6 parcels to Forest Management,based on the following 9 Findings of Fact: <br /> 1. The proposed rezoning to Forest Management would be consistent with the City's <br /> Comprehensive Plan in that the area is forested and undeveloped and is was <br /> designated a Forestry zone under the old Ordinance. <br /> 2.
