b. Metes and Bounds Subdivision, Kevin and Gretchen Wittwer, applicants.
Mr. Marohn explained the Staff Report. Applicants were present.
A motion was made by Bill Habein, seconded by Tom Adams,to approve this metes and
bounds subdivision, subject to the following findings of fact:
1. The land is properly zoned Rural Residential and is suitable in its natural state for
the intended purpose of residential development as existing residential structures
are present on the property.
2. There are no significant natural or historic features on this property that would
constrain future residential development and construction. The property is fairly
flat, so only minor grading and tree removal associated with the construction of a
dwelling will need to be performed.
3. Each lot has ample space for the placement of two individual sewage treatment
systems, and Tract A already has such a system.
4. The proposed subdivision does not contain provisions for water-based recreation
as the property is not adjacent to any water bodies.
5. Both lots meet the minimum buildable lot size of 5 acres, with Tract A being 5
acres and Tract B being 11.4 acres.
6. Both lots meet the minimum lot width of 200 feet, with Tract A being 435 feet
and Tract B being 247.26 feet.
7. The proposed layout of the lots is compatible with the existing layout of adjoining
properties and will not constrain their future development.
8. The proposed side lot lines are parallel and perpendicular to the existing lot lines
of adjacent properties.
9. Each lot in the proposed subdivision has at 33 feet of frontage on the right-of-way
for County Road 16.
All members voted"aye". Motion carried.
OLD BUSINESS: None.
APPROVAL OF MINUTES:
A motion was made by Tom Adams, seconded by Bill Habein,to approve the December
Minutes. All members voted"aye". Motion carried.
*** Staff was directed to develop recommendations regarding Extractive Uses.
ZONING ADMINISTRATOR'S REPORT:
Bittner pointed out the permits issued and letters written. The following Potential
Violations/Enforcement Actions were discussed:
Planning Commission 6
January 19, 2006
