Would like 96 square <br /> feet. <br /> Variance for a Structure Exceeding the Height Limit,A&B Furniture,Allan and Brenda Wiener, <br /> Application 07-21 <br /> Marohn reviews the staff report. <br /> Allan Wiener and Brenda Wiener present. States that they manufacture traditional furniture. <br /> States that the report mentions a wood boiler,which is how the facility is heated. A wood burner <br /> has a lot of smoke,but the boiler would be a certified commercial boiler. It operates at 5,000 <br /> BTU's and runs off of the wood shavings. The boiler and the dust collector therefore need to be <br /> near each other. These also need to be central to the building due to the operation and to <br /> maintain air flow. <br /> Discussion amongst Commission members. <br /> Motion by Hallan to approved the request for a variance based on the following <br /> findings of fact: <br /> i. The proposed use meets the required setbacks, with the proposed structure <br /> being at least 30 feet from all property lines. <br /> 2. The proposed use meets the required impervious coverage limit of 50%, <br /> proposing 41.3%of the lot area as impervious surface. <br /> 3. The proposed manufacturing building meets the building height limit of 25 <br /> feet,being approximately 23.5 feet as measured by the Ordinance standards. <br /> The dust collector,however, measures 28 feet in height. <br /> 4. Strict interpretation of the Ordinance would create an undue hardship on <br /> this business, as the business would not be able to operate in the City <br /> without the required dust collector to meet OSHA standards. Dust collectors <br /> are purchased from third party manufacturers and the dust collection unit <br /> that the applicants require is manufactured at 28 feet in height. <br /> 5. While there are not any characteristics of the land itself that prevent this <br /> property from being developed with most other industrial uses, strict <br /> interpretation of the Ordinance, in this case, would be impractical because <br /> of the pre-manufactured height of a required unit for a wood-working <br /> industrial operation. <br /> 6. The deviation from the Ordinance would be in keeping with the spirit and <br /> intent of the Ordinance,which is to limit the general height of structures for <br /> aesthetic and fire safety purposes. This property, located in the Business <br /> Park, is surrounded by similarly designed principle structures. The <br /> proposed principle structure meets the required height limit, but as <br /> measured from the ground to the peak, is actually taller than the requested <br /> dust collector unit. <br /> 7. The variance, if granted, will not create a land use that is not permitted in <br /> the zone. Manufacturing operations are permitted uses in the Light <br /> Industrial zone, and were it not for the height of the dust collector, would <br /> otherwise be permitted administratively. <br /> 8. The proposed dust collector structure is unlikely to alter the essential <br /> character of the locality, as the structure does not extend beyond the <br />
