Page 6, Findings of Fact 36 & 37,please clarify what <br /> area is being referred to. Mr. Marohn stated the Staff Report should be western shore, <br /> not eastern shore. Mrs. Beaver also stated that Finding of Fact 37 the PUD allowed 34 <br /> mooring sites, but 40 were approved. Mr. Marohn stated that this is the exact Finding <br /> from the last CUP. We used commercial density to determine number of slips at 40. <br /> Cullen lakes Assoc has no objection to the relocation of the lots so along as the density in <br /> the tiers is not increased, or to the lodge facility. For the construction of storage area, we <br /> feel it would be a nice thing if you considered a 50' buffer. <br /> With regard to the suggested conditions of approval, we strongly urge you include <br /> Conditions 10— 12 that has to do with the moorings, as well as 15— 17,things we have <br /> felt strongly about since 2005. If they were not included we would be strongly opposed <br /> to this application. Regarding the beach, or second beach,the CUP application includes a <br /> phrase to create a second beach. The Staff Report states only plans to expand existing <br /> beach. We strongly oppose the second beach for environmental reasons. In 2003 all <br /> parcels on the Cullen Lakes were photographed from the lake. (Mrs. Beaver presented <br /> photos for our records.) In March, 2005 we reported illegal clearing of vegetation along <br /> that peninsula(Mrs. Beaver presented photos for our records) The City disagreed with <br /> our assessment at that time. The City thought otherwise. In November, 2007, a second <br /> beach had been created along that shoreline. (Mrs. Beaver presented photos for our <br /> records) Mrs. Beaver questioned why the City accepted the CUP application when the <br /> applicant is in violation for the construction of that second beach. Chairman Woog stated <br /> that the City is aware of that violation. CLA attended site visit. Applicant altered the <br /> shoreline without a permit. Mrs. Beaver stated that the applicant did request the second <br /> beach. The Staff Report needs to be more clear. The Staff Report could say a second <br /> beach is not approved with this application. May, 2007 DNR conducted vegetation <br /> survey and part of survey indicated shoal substrates and at that second beach area the lake <br /> bottom is silt and marl,no natural sand. The LCA is very strongly opposed to the second <br /> beach. For restoration of beach area, we suggest contacting Beth Hippert at SWCD. <br /> Mr. Williams asked regarding the photos around lake, what is water level today? Mrs. <br /> Beaver stated it may be down a foot,not more. <br /> Paul Reichenbach, 27188 Sarah Lane: The proposed lodge and wellness center—will <br /> they have a paved parking lot? Mr. Miller stated there would be a paved parking lot. <br /> Will it be visible from lake? Mr. Miller stated it would not be visible from the lake.
