i
Mr. Habein stated that with the proposed walkout excavation, there will be a sheer wall to
the neighbor. This will create a severe problem. Mr. Hallan stated a construction
easement would be required from the neighbor.
Mr. Williams verified that the retaining walls indicated on the survey are already in place.
There is no work being done in the Shore Impact Zone. The existing deck does not meet
the setback. The house does meet the setback. The applicant proposes to add two
retaining walls. He stated that there would be little runoff into the lake with the rock
retaining walls in place. He questioned the potential impact to the lake. Mr. Hallan
stated that silt fence would be required.
When asked by Mr. Williams, Mr. Caouette stated that the crawl space is now four feet.
When asked by Mr. Williams, Mr. Caouette stated that they plan to lift the house in
sections, under pinning the house, raise the house, remove the foundation, add the blocks
and set it down again.
Mr. Hallan stated that if it can be picked up it can be moved over to meet the setbacks.
Mr. Williams asked if they moved the dwelling could they do the walkout if it was
outside the 75 foot setback. Mr. Hallan stated there is room to reposition the home so it
is conforming. Mr. Marohn stated that they would need a variance for dirt moving.
Mr. Habein suggested tabling the request so the applicant can contact his builder to see if
they can come up with something more agreeable.
Mr. Caouette stated that there is a four foot crawl space now;they would only be going
an additional four feet deeper.
Mr. Hallan stated that a basement without a walkout or a basement with a small walkout
would be more desirable. Something with less impact and be less visible from the lake.
Applicant may want to go back to the builder and come back with another request.
Mr. Marohn reiterated that an expansion of a non-conforming dwelling requires a
variance. Maintenance is allowed.
Mr. Pederson and Mr. Derksen stated they couldn't vote for this, but there are other
options.
The Planning Commission would like to see an alternative for a full basement, see what
the difficulty would be to moving the structure to make it conforming and is open to
considering a walkout so long as it does not extend beyond the existing deck. They
would also like to know the amount of material that needs to be moved.
Applicant will bring back additional information.
Minutes 4
Pequot Lakes Planning Commission
August 20, 2009
