- If the metes and bounds application is approved the proposed lot for this conditional use <br /> application will contain around 13.9% impervious surface coverage. The adjacent lands <br /> include commercially zoned land to the north and south, State Highway 371 to the east <br /> and undeveloped shoreline residential property to the west.The access to the property is <br /> also contmge`n-t on the metes and bounds application later on the agenda. If the metes <br /> and bounds is approved,the access will be off a tract of land co-owned by the applicants <br /> of this conditional use permit and the metes and bounds application. This tract of land <br /> will have direct access off of State Highway 371. <br /> Applicable Regulations: The purpose and intent of the Commercial District is to <br /> provide a zoning classification for commercial uses oriented around the automobile. <br /> Parcels are larger than in the Downtown Mixed Use zone in order to provide on-site <br /> parking, on-site stormwater facilities, as well as on-site water supply and sewage <br /> treatment where municipal utilities are not immediately available. Section 5.10, Subdivision 4 indicates performance standards that apply to all <br /> developments in the Commercial zone,including: <br /> A. Impervious Coverage. Impervious coverage may be increased by up to 25%, <br /> .. not to exceed 50% of the property, through a conditional use permit if the <br /> following is provided to and approved by the City: <br /> i. A stormwater retention plan showing containment of the 10-year, 24- <br /> hour storm even on the parcel. <br /> ii. Direct runoff of stormwater to adjacent properties and wetlands shall <br /> be eliminated through the use of berms, infiltration ponds, swales, <br /> filtration strips,or other permanent means. <br /> B. Compatibility of Use. Use shall be compatible with the surrounding <br /> neighborhood. Uses shall not present noise, odor, light nuisances, or any <br /> other nuisance. <br /> C. Parking. Off-street parking shall be provided as per Section 7.10. On-street <br /> parking is not allowed under any circumstances. To reduce the visual impacts <br /> and amount of surface parking, shared parking and surface parking shall be <br /> located behind or to the side of a building. Additionally, suitable trees and <br /> shrubs shall be plated between parking lots and all adjacent sidewalks, roads, <br /> lots,and buildings. <br /> D. Screening. All sites shall be heavily landscaped to provide l00% screening to <br /> adjacent residential parcels and over 50% screening from the road or any <br /> non-residential parcel. Percentages shall be determined by amount of <br /> structure that can be seen during leaf-on conditions.
