You would be allowed to cut down the dead trees that are supporting the deck and replace them with cement <br /> footings and 4 X 4 or 6 X 6 posts. <br /> 2. You would need to move the posts back to the 10-foot setback from the Ordinary Highwater Mark; you would <br /> not be allowed to place the new posts where the dead trees are now. <br /> Replace existing cabin: <br /> 1. You would be allowed to tear down the existing, nonconforming structure and rebuild to the exact <br /> dimensions. These two actions would be included on the same Land Use Permit and the new structure would <br /> need to begin being constructed within one year of permit issuance. The new structure could not be built at <br /> some time in the future. <br /> 2. You could not move the cabin into the setback because your neighbors dwellings sit further into the <br /> setback. That is only allowed where municipal sewer service is available. You would need to construct the new <br /> cabin within the building envelope indicated on the survey. <br /> 3. You could replace the existing well shed, but it could only be used as such,with no increase in dimensions. A <br /> deck could not be built as part of the replacement. A deck would need to be within the building envelope <br /> indicated on the survey. <br /> Move driveway: <br /> 1. There would be a permit required from the City to move the driveway as I believe Lakewood Avenue is a City <br /> street. The new driveway would need to meet the 10-foot setback from the side yard setback.
