A motion was made by Mark Hallan, seconded by James Oraskovich,to approve <br /> the Metes and Bounds Subdivision,based on the following Findings of Fact as <br /> listed by Staff with revision to Number 8,with no conditions regarding garage <br /> access or easement: <br /> 1. The subject property is located at 31343 North Oak Street and is zoned <br /> Shoreline Residential. <br /> 2. Both of the proposed tracts meet the requirements of the Shoreline <br /> Residential Zone. <br /> 3. "Tract A" contains a conforming single family dwelling and two <br /> conforming accessory structures. "Tract B" contains an existing dwelling, <br /> two conforming accessory structures and a pre-existing water oriented <br /> structure that is located within the lake setback. <br /> 4. Both of the proposed tracts contain conforming private sewer systems. <br /> "Tract A" contains a deep water well and "Tract B" contains a shallow <br /> water well. <br /> 5. The property is suitable in its natural state for the intended purpose and <br /> this lot split would not be harmful to the health, safety, or welfare of future <br /> residents or of the community. <br /> 6. The proposed subdivision will increase the number of properties on the <br /> Sibley Lake but will not significantly increase the demand for water-based <br /> recreation as the number of dwellings is not increasing. <br /> 7. The proposed lot layouts meet the requirements of the ordinance. <br /> 8. The proposed side lot lines are radial to the lakeshore and parallel to the <br /> existing property line of the adjacent property. <br /> 9. Each of the proposed parcels contains more than 33-feet of frontage on <br /> public right-of-way. <br /> lo. Each of the proposed properties meets the requirements of the code for <br /> stromwater management. <br /> 11. There are no public streets proposed with this request. <br /> All members voted"aye". Motion carried. <br /> ADJOURNMENT: <br /> A motion was made by Planning Commission Member Brown, seconded by <br /> Planning Commission Member Hallan,to adjourn the meeting. All members <br /> voted"aye". Motion carried.
