OPEN FORUM: None. <br /> NEW BUSINESS: <br /> Wilderness Resort Conditions Update,Thomas Steffens <br /> Mr. Steffens was present. Mr. Burslie explained Mr. Steffens requested to be on the <br /> Agenda to go over the conditions of his Conditional Use Permit approval; the conditions <br /> are included in the Staff Report. <br /> Mr. Steffens stated he wished to discuss the alleged DNR violation which resulted in his <br /> Preliminary Condominium Plat application to be rejected. He passed out the Lake <br /> Association letter to the City and a chronology of the DNR violation, as well as photos <br /> taken by the Lake Association and himself. He had applied for a permit from the DNR <br /> to remove aquatic vegetation and met onsite on August 11. <br /> Mr. Steffens stated Mr. Mueller issued a Memo regarding the August 11 site visit which <br /> stated the dock would be extended by 30 feet and moved further south. Mr. Steffens <br /> stated he had not agreed to move the dock south. Mr. Steffens provided a drawing of his <br /> plan to move the docks out of the bulrushes. <br /> Mr. Steffens stated he needs the Preliminary Condominium Plat to be included on the <br /> September Agenda; he is asking the Planning Commission for a determination that the <br /> process can proceed while the violation is resolved. <br /> Mr. Burslie stated the City received a telephone call from the DNR and the City Attorney <br /> was consulted. Mr. Steffens is not in violation of the City Code,but the DNR rules. The <br /> City Attorney advised Staff to reject the Preliminary Condominium Plat application. <br /> The City needs to receive correspondence from the DNR that they are satisfied with the <br /> restoration; once that is received the City can move forward with his applications. <br /> Mr. Burslie further stated that Final Plat cannot be approved until all of the conditions <br /> have been met. The Committee will go onsite and make sure conditions have been met. <br /> Mr. Steffens stated the Grading Plan, etc., have been submitted. <br /> Mr. Burslie reminded Mr. Steffens there were 25 conditions included. Mr. Steffens <br /> stated there were conditions that were never discussed,such as the Lighting Plan, <br /> Vegetation Plan and Grading Plan. He had the audio from the meeting transcribed and <br /> the Lighting Plan and Vegetation Plan for the entire resort were never mentioned. The <br /> Vegetation Plan for the Lodge was discussed. Mr. Burslie stated they were included in <br /> the Staff Report and may not have been discussed at length.
