I. The property is properly zoned Shoreline Residential. The property is <br /> currently used for residential purposes. <br /> 2. Both Tracts A and B would be ioo.oi feet in width at the OHW and 96 feet in <br /> width at the building line. <br /> 3. Both Tracts A and B have more than 20,000 square feet of buildable area. <br /> Neither Tract A nor Tract B would be constrained from future development. <br /> 4. Tract A would not contain any structures, only part of a driveway. Tract B <br /> would contain two cabins and a shed. One cabin currently encroaches on the <br /> south-west property line side yard setback and the other cabin would not <br /> meet the side yard setback for the new lot line between Tracts A and B. <br /> 5. All the structures meet the 30 foot right-of-way setback for County Road 107, <br /> and the 75 foot OHW setback. <br /> 6. The cabin structures on Tract B do not meet the ten foot side yard setback. <br /> One is a pre-existing non-conformity the other non-conformity is being <br /> created from the lot split. The applicant has indicated that all of the existing <br /> structures will be removed by the end of August of 2009. <br /> 7. The survey does not indicate the impervious surface coverage but both lots <br /> seem as though they would be under 20 percent. <br /> 8. The survey does not indicate sizes nor height of existing structures. <br /> 9. Tract B would contain two dwellings and contains over 40,000 square feet <br /> of buildable area. The second dwelling would be a new non-conformity <br /> since the property does not contain the allowed amount of shoreline width <br /> to provide for a second dwelling <br /> io.The survey does not indicate whether or not there is septic on the lots. <br /> ii. The property is suitable in its natural state for the intended purpose and this <br /> lot split would not be harmful to the health, safety, or welfare of future <br /> residents or of the community. <br /> 12.The applicant has not indicated whether or not the non-conforming <br /> structure will be removed or moved. <br /> 13.It is unknown whether or not the lots contain a SSTS system. <br /> 14.The applicant is not proposing any provisions for water-based recreation. <br /> 15.Neither Tract A nor Tract B will conform to the minimum dimensions for a <br /> Shoreline Residential property. <br /> 16.The proposed lot layouts are compatible with the existing layout of adjoining <br /> properties and the proposed lot lines are parallel and perpendicular to j <br /> existing lot lines. Future development will not be constrained by the <br /> proposed lot layouts. <br /> 17. The proposed side lot line is at right angles to the existing road line and the <br /> property line of the adjacent property. <br /> 18.Both Tract A and Tract B meet the minimum frontage on public right-of-way <br /> requirement of 33 feet. <br /> I <br /> With the following conditions included in the approval: <br /> I <br /> 1. The northerly cabin, which is made non-conforming by the proposed <br /> subdivision, shall be removed prior to the City Staff providing the <br /> certification necessary for the subdivision to be recorded. <br /> 2. The applicant shall provide an easement so as to facilitate a shared driveway <br /> accessing off of Coutny Road 107. i <br /> L Passed unanimously. <br /> I <br />
