COMMUNITYGROWTH <br /> I N S T I T U T E Gly•f <br /> Ewrperis in Small Town Planning Peouott <br /> NEW BUSINESS—LIBRARY PURCHASE <br /> Agenda Item:6(b) <br /> Background Information and Discussion: The Pequot Lakes Library Board and <br /> the City Council have authorized the purchase of Little Pine Plaza to be used for the <br /> Pequot Lakes Community Library. It is the intention of the Library Board to raise the <br /> money to purchase the building without using taxpayer dollars. The purchase of this <br /> building will allow the library to expand and to offer more library programs. <br /> City Council Motion— 612/2009 <br /> COUNCIL MEMBER MALECHA MOVED TO PURSUE THE <br /> PURCHASE OF THE BUILDING KNOWN AS LITTLE PINE PLAZA <br /> FOR THE LIBRARY AND FURTHER INSTRUCTS STAFF TO REVIEW <br /> FUNDING OPTIONS. COUNCIL MEMBER SJOBLAD SECONDED THE <br /> MOTION. MOTION CARRIED 5-0. <br /> State Statute Number 462.256, Subdivision 2, states that if the City has a comprehensive <br /> plan, the Planning Commission must review the transaction to determine if it is <br /> consistent with the plan. The Planning Commission must then report in writing to the <br /> governing body its findings as to compliance of the proposed acquisition with the <br /> comprehensive municipal plan. <br /> The Library Board is trying to purchase this property before July ist to avoid paying <br /> another year of property taxes. Therefore, it would be appreciated if the Planning <br /> Commission can submit its findings to the Council as soon as possible. <br /> State Statute #462.356, Subd. 2.Compliance with plan. <br /> After a comprehensive municipal plan or section thereof has been <br /> recommended by the planning agency and a copy filed with the governing <br /> body, no publicly owned interest in real property within the municipality <br /> shall be acquired or disposed of, nor shall any capital improvement be <br /> authorized by the municipality or special district or agency thereof or any <br /> other political subdivision having jurisdiction within the municipality <br /> until after the planning agency has reviewed the proposed acquisition, <br /> disposal, or capital improvement and reported in writing to the governing <br /> body or other special district or agency or political subdivision concerned, <br /> its findings as to compliance of the proposed acquisition, disposal or <br /> improvement with the comprehensive municipal plan. Failure of the <br /> planning agency to report on the proposal within 45 days after such a <br /> reference, or such other period as may be designated by the governing <br /> body shall be deemed to have satisfied the requirements of this <br /> �..- subdivision.
