It has been established at <br /> this location for years and has demonstrated compatibility with the area. <br /> 8. The use has been established for years and there have been no instances of injury <br /> to the public health,safety or welfare. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> conditional use permit, deny the application, or table the request if additional <br /> information is needed. If the motion is for approval or denial, findings of fact should be <br /> cited. <br /> Staff Recommendation: After reviewing the Code and the application, we <br /> recommend that the Planning Commission adopt the proposed findings of fact i through <br /> 3 regarding the legal, non-conforming use and thus provide for the continued unfettered <br /> use of the property as a call center. This would recognize that the call center is an <br /> existing, legally-created, non-conforming use that could be continued at the site <br /> indefinitely. <br /> This would not require a rezoning to commercial and would also therefore not <br /> technically require a conditional use permit.
