I also, reviewed the title insurance policy that covers the property contained <br /> within the final plat and the condition of title is in order for purposes of final plat approval. I did <br /> request that the lender with the mortgage on the property, Lakes State Bank, have the title insurance <br /> company that issued the title policy provide us with an updated title insurance commitment. I expect <br /> we will receive that shortly. <br /> I did previously meet with the surveyor, Pat Trottier, that prepared the Common Interest Community <br /> Plat and I discussed with Mr. Trottier what the Planning Commission and/or staff may require as part <br /> of the final plat approval and Mr. Trottier indicated what he understood where specific items that <br /> would need to be addressed in the Declaration of Covenants for the Plat. I drafted the necessary <br /> association documents for the common area identified on the Plat as well as the necessary <br /> Declaration of Covenants for the Plat. I drafted those documents with the understanding that my role <br /> in terms of drafting documents was for purposes of ensuring that the documents were consistent with, <br /> and incorporated if necessary, conditions of approval by the City. <br /> I included within Section 20 of the draft Declaration, the items that I understood the Planning <br /> Commission and/or staff would require as conditions of approval for the final plat. I incorporated <br /> those items specifically within the Declaration so that all future owners of lots within the Plat would <br /> be aware of the conditions of approval as it specifically relates to utilities and maintenance thereof,as <br /> well as how any future special assessment would be billed and collected by the City. If the Planning <br /> Commission and/or staff have additional conditions of approval that the Commission would like to <br /> incorporate, my suggestion would be that we review those additional conditions and determine if it <br /> would be appropriate to include those in the Declaration. <br />
