Section 6.4 shall be allocated to Units as set forth in that Section. Real estate taxes, <br /> insurance and other expenses associated with maintenance of the common area shall <br /> be apportioned between the Units based upon the percentage of ownership of the <br /> common area. <br /> 6.2 Annual Assessments. Annual Assessments shall be established and <br /> levied by the Board, subject to the limitations set forth hereafter. Each annual <br /> Assessment shall cover all of the anticipated Common Expenses of the Association for <br /> that year, which are to be shared equally by all Units in accordance with the allocation <br /> set forth in Section 4.2. Annual Assessments shall be payable in equal monthly <br /> installments. Annual Assessments shall provide, among other things, for an adequate <br /> reserve fund for the maintenance, repair and replacement of the Common Elements <br /> and those parts of the Units for which the Association is responsible. Annual <br /> assessments shall be due and payable July 1 of each year. <br /> 6.3 Special Assessments. In addition to annual Assessments, and subject to <br /> the limitations set forth hereafter, the Board may levy in any Assessment year a special <br /> Assessment against all Units equally in accordance with the allocation formula set forth <br /> in Section 4.2. Special assessments shall be used for the purpose of defraying in whole <br /> or in part the cost of any unforeseen and unbudgeted Common Expense. <br /> 6.4 Limited Allocation Assessments. In addition to annual Assessments and <br /> special Assessments, the Board may, at its discretion, levy and allocate limited <br /> allocation Assessments among only certain Units in accordance with the following <br /> requirements and procedures: <br /> a. Any Assessment associated with the maintenance, repair, or replacement <br /> of a Limited Common Element may be assessed exclusively against the <br /> Unit or Units to which that Limited Common Element is assigned. <br /> b. Any Assessment or portion thereof benefiting fewer than all of the Units <br /> may be assessed exclusively against the Unit or Units benefited. <br /> C. The costs of insurance may be assessed in proportion to the square <br /> footage or actual cost per Unit and the costs of utilities may be assessed <br /> in the proportion to usage. <br /> d. Reasonable attorneys' fees and other costs incurred by the Association in <br /> connection with (i) the collection of Assessments and (ii) the enforcement <br /> of the Governing Documents, the Act, or the Rules and Regulations, <br /> against an Owner or Occupant, may be assessed against the Owner's <br /> Unit. <br /> e. Late charges, fines and interest may be assessed as provided in Section <br /> 14. <br /> f. Assessments levied under Section 515B.3-116(a) of the Act to pay a <br /> judgment against the Association may be levied only against the Units <br /> 9 <br />
