COMMUNITYGROWTH 'Goof <br /> _ <br /> i N S T i T U T E Pequot <br /> Evperts in Small Town Planning <br /> STAFF REPORT <br /> Application: Variance to Exceed 25 Percent Impervious Coverage Limit and Variance <br /> from Buffer Zone Vegetation Requirements <br /> Applicant: Paul Tucci, Oppidan Inc. <br /> Agenda Item:3(e) <br /> Background Information: The applicant initially requested a variance to exceed the <br /> 25 percent impervious surface limit and a variance from the TH 371 buffer zone <br /> vegetation requirements as part of the grocery store application.After the Design Review <br /> Team met with the applicant,a decision was made to pursue a rezoning to DMU. <br /> If the property is rezoned to DMU,these variance requests would no longer be necessary. <br /> If the rezoning is not approved, it is likely that the City will be asked to consider these <br /> two variances. <br /> The variance from impervious surface is requested as the applicant is proposing <br /> approximately 75 percent surface cover where only up to 50 percent is allowed, with a <br /> stormwater management plan,in the Commercial zone. <br /> A variance is also requested from the buffer zone vegetation requirements for the <br /> Commercial zone. The applicant would be required to maintain a minimum of one tree <br /> per each 200 square feet of property for a depth of fifty (50) feet from the Highway 371 <br /> right-of-way into the development. The number of trees required would be loo with 30 <br /> of those being small trees, 18 evergreens, and 52 large trees required. The applicant is <br /> proposing 23 small trees, to evergreens,and 14 large trees. <br /> Staff Recommendation: Staff is recommending the Variance requests be tabled <br /> pending the decision of rezoning the subject property to Downtown Mixed Use at the <br /> Council level. <br /> i <br /> I <br /> i <br /> Pequot Lakes Staff Report 3(e)-i <br /> August 20,2009 <br />
