Vote on reconsideration: All members voted"aye". Motion carried. <br /> The Conditional Use Permit is back open: <br /> Mr. Steffens stated that it is not as important to build the lodge now as the amenities <br /> building. <br /> The Planning Commission suggested that no additional building permits in excess of 20 <br /> will be issued unless the amenities building is constructed and operational. The 21"unit <br /> will be the trigger; 40 units for the lodge construction. <br /> PUBLIC COMMENT: <br /> Paul Reichenbach, 27188 Sarah Lane, asked if the units were single family units or <br /> structures. <br /> Sue Moore, 90302 Seminol Bay, Pequot Lakes—Is there any consideration to those <br /> people already there? Who is financially responsible to keep up the amenities building? <br /> Mr. Marohn explained there are 60 owners after it is all done; now there are 9 owners <br /> plus 1 owner who owns 51. <br /> A motion was made by Tom Adams, seconded by Mark Hallan,to add an additional <br /> Condition to the Conditional Use Permit previously approved stating: <br /> 19.No additional building permits will be issued after 20 until the amenities <br /> buildin ss s constructed and operational and, in addition, no additional building <br /> permits will be issued after 40 units are built until the lodge is constructed and <br /> operational. <br /> Chairman Woog called for the vote: 6 ayes, 1 nay (John Derksen). Motion carried. <br /> df <br /> A motion was made by Mark Hallan, seconded by Tom Adams,to approve the <br /> Preliminary Plat, based on the following Findings of Fact as stated in the July Staff <br /> Report: <br /> 1. The property is zoned waterfront commercial and open space. A realignment of <br /> the commercial waterfront zone will need to be done concurrent with a final plat <br /> application. <br /> 2. The plat creates 60 commercial shoreline dwelling units plus 46 lots dedicated for <br /> accessory structures, one Outlot A and one common remnant lot. <br /> 3. As a PUD, lot size dimensions are not factored in. Instead, overall density and <br /> density by tier is considered. This proposal meets the required density, which was <br /> considered under the PUD application. <br /> 4. No lots will require a variance for development based on the conditions of the <br /> PUD approval. <br /> 5.
