� Staf�' Findings: We have reviewed the application and propose the following findings of <br />fact for you to consider: <br />1. A beauty salon as a home occupation is an appropriate conditional use in the <br />Medium-Density Residential zone. <br />2. The proposed salon will be located on a lot serviced with public facilities and <br />adjacent to a public access road. <br />3. The proposed salon will be located in the garage and will not take up more <br />than 50% of the gross area of the garage. <br />4. The proposed salon will not generate more than two (2) customer vehicles at <br />one time, and will provide adequate off-street pazking for those vehicles. <br />There is no indication that the proposed use will generate more traffic on <br />existing access roads. <br />5. A beauty salon is compatible with adjacent residential and commercial uses. <br />6. The proposed salon, with conditions, will not be injurious to the health, safety, <br />and welfaze of citizens in the City of Pequot Lakes. <br />7. The proposed salon, with conditions, is consistent with the intent of the Draft <br />Comprehensive Plan, the current Medium-Density Residential zone, and the <br />proposed future Downtown Mixed Use district. <br />8. The proposed salon will not require additional public facilities and will not <br />change the topography or drainage of the land. <br />9. The proposed salon is not in a shoreland area. <br />� Planning Commission Direction: The Commission can recommend to the Council that <br />it approves the Conditional Use Permit. A recommendation of denial could also be made. <br />If Commission members feel they need more information to make a decision; the missing <br />information should be indicated and the application should be tabled. <br />� <br />Staff Recommendation: We recommend that the Planning Commission approve the <br />conditional use permit based on the findings provided in this report. We recommend that <br />the permit be approved subject to the following conditions: <br />1. Hows of operation in a residential neighborhood shall be limited to the hours <br />between 7 AM and 10 PM in accordance with the Ordinance. <br />2. On-site parking shall be limited to the e�usting driveway. <br />3, The owner of the studio shall be a full-time occupant of the dwelling and the <br />primary use of he property shall remain residential until such time that a the <br />zoning classification of the properiy changes, at which time the conditional <br />use pemut could be re-evaluated. <br />4. Signage shall be consistent with the Ordinance provisions for residential <br />a.reas. <br />S. The operation of the conditional use sha11 be reviewed in 12 months at which <br />time conditions may be modified, added, or removed to address specific <br />concems. <br />January 2004 Staff Report Page S <br />
