2. The typical hours of operation for the proposed business are between 6 A.M. and <br /> io P.M., y days a week. <br /> 3. The proposed use will primarily take place in an existing pole building and a <br /> large,fenced in area. <br /> 4. The occupancy at any given time will be between 20-25 dogs. <br /> 5. The proposed business is considered an Animal Boarding Facility and requires a <br /> conditional use permit in the Rural Residential Zone. <br /> 6. The proposed fence is 7 feet in height while the ordinance has a 5 foot maximum <br /> in the Rural Residential Zone. <br /> 7. The proposed sign for the business will be setback one foot from the Road Right <br /> of Way and is 92 sq. ft. (6' x 8' two sided) while typically only a three (3) square <br /> foot sign is allowed in residential zoning districts. <br /> 8. The use is an appropriate conditional use in the Rural Residential Zone. <br /> 9. The use with conditions, conforms to the comprehensive land use plan. <br /> io. The surrounding properties are zoned Rural Residential and Forest Management. <br /> The proposed use is compatible with the existing neighborhood. <br /> ii. The use with conditions,will not be injurious to the public health, safety,welfare, <br /> decency, order, comfort,convenience,appearance or prosperity of the City. <br /> 12. Most activities at the facility will either be in the pole shed or fenced in area. The <br /> conditional use will not impede the normal and orderly development and <br /> improvement of surrounding vacant property for uses predominant in the area. <br /> 13. No new public facilities or services are required for the proposed use. <br /> 14. The proposed use will use existing vehicular approaches. Clients will be coming <br /> and going at different times throughout the day, as to not create traffic <br /> congestion or an interference with traffic on surrounding public throughfares. <br /> 15. There is sufficient off-street parking at the facility. <br /> `— 16. There will be no odor, fumes, dust, or vibration produced by the proposed use. <br /> There will b a influx of noise (dogs barking). The dogs will be housed inside <br /> from the hours of io P.M. until 6 A.M., so that noise will not be an issue during <br /> those hours. <br /> 17. There are not any known natural, scenic or historical features of major <br /> significance at the property. <br /> 18. The conditional use, with conditions, will promote the prevention and control of <br /> pollution of the ground and surface waters including sedimentation and control <br /> of nutrients. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> conditional use permit, deny the application, or table the request if additional <br /> information is needed. If the motion is for approval or denial, findings of fact should be <br /> cited. <br /> Staff Recommendation: The proposed use is allowed in the zone and the applicant <br /> appears to meet all conditions for approval. Unless the Planning Commission raises <br /> other concerns that cannot adequately be addressed,we recommend that the application <br /> be approved subject to the following conditions. <br /> 1. Not more than 25 dogs shall be allowed on the property at any given time. <br /> 2.
