COMMUNIT'Y ly of <br /> JrROV 7rH P"equot _ <br /> INSTITUTE e <br /> STAFF REPORT <br /> Application: Conditional Use Application for Additional Signage(continuation) <br /> Applicant: Brian Laudenbach, BLMM, LLLC <br /> Agenda Item:4(b) <br /> Background Information: The Planning Commission has approved the <br /> reconstruction of the Oasis facility along with the opening of the drive-thru for the Dairy <br /> Queen. Additionally, the Planning Commission has approved additional signage for the <br /> facility through the Sign Concept Plan process. <br /> The approvals of the Planning Commission explicitly excluded the digital reader board <br /> that has been requested by the Dairy Queen. Action on that sign was tabled to the May <br /> meeting so that an ordinance amendment could be considered. <br /> Between the April and May meetings, the property owner requested modifications to the <br /> approved site plan and conditions for the addition of the drive-thru. Specifically, the <br /> property owner is now requesting additional impervious surface coverage to allow an <br /> access road to be placed along the western side of the property, giving access to the <br /> adjacent parcel. This would shrink the size of the stormwater retention area. The <br /> property already exceeds the allowable impervious coverage limitation. <br /> Applicable Regulations: An ordinance amendment addressing digital signage has <br /> been prepared. A public hearing on that amendment is to be discussed prior to this <br /> hearing. <br /> Planning Commission Direction: The Planning Commission can approve of the <br /> digital sign or deny the sign component of the application. The application cannot be <br /> tabled beyond the May meeting. <br /> If the motion is for approval or denial,findings of fact should be cited. <br /> Staff Recommendation: The Planning Commission should address the digital <br /> signage consistent with the recommendation made on the ordinance amendment. Any <br /> approval would need to be contingent on City Council adoption of an amendment. <br /> In regards to the additional impervious surface, the Planning Commission can address it <br /> in the context of this conditional use permit. It would require a modification to the <br /> original conditions of approval, which required the area to be reserved for green space <br /> and stormwater management. The Planning Commission could also elect not to reopen <br /> this aspect of the application. If the applicant wished to establish the access, a variance <br /> for impervious coverage would then be required. <br /> Pequot Lakes Staff Report 4(b)-1 <br /> May 20,2010 <br />
